Danang beach hotel owner fined, forced to apologize to guests for dirty room with rat droppings

On May 10, the People's Committee of Ngu Hanh Son District said it had drawn up a record to consolidate the penalty file, and at the same time forced the owner of a hotel in the Da Nang coastal area to apologize to tourists for the poor quality of the rooms.

According to the People's Committee of Ngu Hanh Son District, on May 6, the Department of Tourism and the People's Committee of the district received a complaint from female tourist Tran Thi Thuy Dung about the dirty hotel room at Sea Sand Hotel 1 (An Thuong 3 Street, My An Ward, Ngu Hanh Son District).

This is a hotel located in the "Western Street" An Thuong area, Da Nang beach. Previously, this tourist stayed in room 601 of Sea Sand Hotel 1 from April 5 to 22. "When I first entered, I saw the floor was a bit dirty and the pan was moldy. I cleaned it myself because I thought it was small and I often clean it" - Ms. Dung said.

On April 22, she checked out and went to Hue , but on May 1, she returned to Da Nang beach, so she paid nearly 4.4 million VND in advance for the hotel to reserve room 601 from May 1 to 13.

However, on May 1, when Ms. Dung returned to check in to room 601, the hotel announced that someone had stayed there and asked her to choose another room.

Ms. Dung went to see 2 rooms and found them dirty so she did not agree and was temporarily assigned to room 801, but this room had not been cleaned yet, there was mouse droppings under the bed and near the sofa. She requested the room to be cleaned many times but the hotel only did it at night.

"After that, the hotel informed me to change to room 601 but I couldn't change. I asked to pay for the remaining days and change hotels. My holiday was ruined because of this hotel" - Ms. Dung was upset.

On May 7, the inspection team of Ngu Hanh Son District People's Committee worked with the legal representative of Sea Sand Hotel 1, Ms. Le Thi Bich Hai, thereby making a record of the violations.

Specifically, the hotel violated the contract with the tourist by not ensuring the legal rights and interests. The accommodation facility issued a receipt and agreed with the tourist Tran Thi Thuy Dung to register to stay in room 601 from May 1 to 13.

However, on May 1, Sea Sand Hotel 1 did not hand over room 601 as agreed.

The hotel also violated regulations on minimum technical facilities and tourist accommodation services. Specifically, this facility did not replace mattress covers or mats or blankets or pillow covers when there were new guests.

After working, the inspection team unanimously concluded and advised the People's Committee of Ngu Hanh Son District to administratively sanction Sea Sand Hotel 1 for the act of "not ensuring the legitimate rights and interests according to the contract signed with tourists" as prescribed in Clause 5, Article 10, Decree No. 45/2019 of the Government regulating administrative sanctions in the field of tourism.

According to regulations, the fine for this act is from 10 to 15 million VND for individuals and from 20 to 30 million VND for organizations.

Ngu Hanh Son District People's Committee requested the owner of the establishment to contact tourist Tran Thi Thuy Dung to apologize for the violations and notify Ms. Dung of the inspection team's conclusion.

The District People's Committee also warned Ms. Bich Hai to ensure minimum technical facilities when providing accommodation services. If she repeats the offense, she will be held responsible according to the law.

The legal representative of Sea Sand Hotel 1, Ms. Le Thi Bich Hai, agrees with the above contents and commits to implement and remedy.
