The Vice Chairman of the Law and Justice Committee proposed to establish a specialized Court under the International Financial Center in the People's Court organization system.

BBK - On the morning of May 19, the National Assembly discussed in the hall the draft Law amending and supplementing a number of articles of the Law on Organization of People's Courts. Vice Chairman of the National Assembly Nguyen Khac Dinh chaired the meeting.

The draft Law amending and supplementing a number of articles of the Law on Organization of People's Courts submitted at this session focuses on amending and supplementing regulations related to the organization, tasks and powers of People's Courts, the number, standards and conditions for appointing judges of the Supreme People's Court and related regulations; National Assembly deputies basically agreed on the scope of amendments and supplements; the consistency with the Party's policies and guidelines; the constitutionality and consistency of the draft Law with the legal system.

At the discussion session, Vice Chairwoman of the National Assembly's Committee on Law and Justice Nguyen Thi Thuy (deputy of Bac Kan delegation) raised and analyzed the importance of the International Financial Center and the establishment of a specialized court under this Center. However, according to the delegate, the draft Law has not yet timely institutionalized the content stated in the Conclusion of the Politburo on assigning the Supreme People's Court to study the establishment of a specialized court under the International Financial Center and directing the Council of Judges to guide the application of a number of principles of the Common Law system in resolving disputes at this center. Accordingly, the delegate proposed to consider the following 4 contents:

Firstly, in Article 4 on the organization system of the People's Court, it is proposed to add a specialized Court under the International Financial Center.

Second, in Article 48 on the Council of Judges of the Supreme People's Court, it is proposed to add the task of guiding the application of the principles of the Common Law system, as a basis for resolving disputes at the International Financial Center.

Third, for Articles 94 and 95 regulating the criteria and conditions for appointing judges, delegates proposed adding a clause regulating open and specific criteria to serve as a basis for selecting judges to adjudicate at the International Financial Center.

Fourthly, regarding the jurisdiction of the Specialized Court at the International Financial Center, the delegate suggested that the jurisdiction of this Court should not be too specific in the Law on the Organization of Courts and recommended that the Supreme People's Court in the coming time have a Project to comprehensively resolve this issue. The Project needs to clarify issues such as: The internal organization of the Specialized Court at the International Financial Center; the procedural relationship between the Specialized Court and other Courts in the Court system; the selection of Judges for the trial at this center; the procedural principles and procedural order for the operation of the Specialized Court at the International Financial Center.

Also in the morning session, the National Assembly listened to the Minister of Construction, authorized by the Prime Minister, present the Report on the investment policy of the Quy Nhon - Pleiku Expressway Construction Investment Project, the Report on adjusting the investment policy of the Bien Hoa - Vung Tau Expressway Project, Phase 1, and the Chairman of the Economic - Financial Committee reported on the verification of the above two reports./.
