How to manage and use donations to support recycling?

Management and use of donations to support recycling

According to the provisions of the Law on Environmental Protection 2020 and Decree No. 08/2022/ND-CP, financial contributions to support recycling by manufacturers and importers are used to support activities of classifying, collecting, transporting, recycling, processing products, packaging and administrative management costs to support the implementation of recycling responsibilities of manufacturers and importers.

Financial support for product and packaging recycling activities is regulated as follows: Before September 30 of each year, the Ministry of Natural Resources and Environment shall publicly announce the criteria, priorities, and levels of financial support for the following year's product and packaging classification, collection, transportation, recycling, and treatment activities according to the proposal of the National EPR Council;

Agencies and organizations in need of financial support must submit a request to the Ministry of Natural Resources and Environment before October 30 every year for consideration and support.

The receipt and use of financial contributions to the Vietnam Environmental Protection Fund to support recycling must be public, transparent, and for the right purpose.

The National EPR Council reviews and votes to approve financial support requests from agencies and organizations and submits them to the Ministry of Natural Resources and Environment;

The Ministry of Natural Resources and Environment approves the appraisal results and financial support proposals as proposed by the National EPR Council;

The organization assigned by the Ministry of Natural Resources and Environment shall notify and sign support contracts with agencies and organizations receiving financial support;

Vietnam Environmental Protection Fund shall make payment of support amounts to agencies and organizations according to signed contracts.

The receipt and use of financial contributions to the Vietnam Environmental Protection Fund to support recycling must be public, transparent, and for the right purpose (only supporting recycling activities). The Vietnam Environmental Protection Fund is responsible for reporting to the Ministry of Natural Resources and Environment, the National EPR Council, and publicly announcing the receipt and use of financial contributions to support recycling annually before March 31 of the following year.

Currently, the Ministry of Natural Resources and Environment is drafting a Circular of the Minister of Natural Resources and Environment promulgating the Regulations on the management and use of financial contributions to the Environmental Protection Fund to support recycling by manufacturers and importers. This Circular will detail the management and effective use of this money and must ensure publicity, transparency, and proper purposes in accordance with the provisions of law.

Handling of financial contribution violations

Also according to the provisions of Decree No. 08/2022/ND-CP, manufacturers and importers who do not perform or do not properly or fully perform their recycling responsibilities as prescribed by law will be subject to administrative sanctions for each specific violation.

Currently, the Ministry of Natural Resources and Environment has submitted and the Government will soon issue a Decree regulating administrative sanctions for violations in the field of environmental protection, including handling violations related to the recycling responsibility of manufacturers and importers.
