Mr. Le Tri Thanh - Chairman of the Provincial Vietnam Fatherland Front Committee and Mr. Nguyen Phi Hung - Permanent Vice Chairman of the Provincial Vietnam Fatherland Front Committee co-chaired the conference.
Mr. Nguyen Truong Son - Deputy Director of the Department of Natural Resources and Environment (the drafting agency) said that, in order to carry out the tasks assigned by the Provincial People's Committee, the unit has recently focused on developing and completing the draft Regulations on compensation, support and resettlement when the State acquires land in the province. The Department of Natural Resources and Environment has issued documents for localities and specialized sectors to study and comment on, and has recorded many comments, which have been added to the draft.
The Draft Regulations on compensation, support and resettlement when the State acquires land in the province have 5 chapters and 28 articles with many detailed and specific regulations according to the 2024 Land Law and Decree No. 88 dated July 15, 2024 of the Government on compensation, support and resettlement when the State acquires land. The draft aims to ensure maximum legal and legitimate rights of land users.
At the conference, representatives of departments, branches and localities discussed and gave comments to clarify many contents of the draft; focusing on Article 3 (Compensation by residential land when the State recovers residential land), Article 4 (Compensation by land with purposes other than the recovered land type). Many delegates proposed to amend the content on the conditions for arranging a second plot for households with two or more couples according to the guidance referring to the specific conditions stipulated in Clause 4, Article 20 of the draft without further explanation. This will avoid the current inconsistent understanding in localities about the condition of "actually living together on a recovered residential land plot".
In addition, many delegates said that it is necessary to have specific regulations in cases that are eligible for resettlement, especially not to include the content "if the locality has conditions for resettlement land fund, the District People's Committee will consider and allocate a residential land plot with an area according to the detailed planning" because it will create unfairness among cases of land recovery...
Speaking at the conference, Chairman of the Provincial Vietnam Fatherland Front Committee Le Tri Thanh emphasized that this draft clearly demonstrated collective intelligence in issuing a new regulation applicable to the entire province. The principle is that the regulations on compensation, support, and resettlement when the State reclaims land in the province must comply with the provisions of the law. However, we should not be too perfectionist because land is always a complicated field. Many issues arise that cannot be resolved completely; the regulations need to be strict and have time to respond to practice, then continue to be supplemented and adjusted.
Chairman of the Provincial Vietnam Fatherland Front Committee Le Tri Thanh also suggested that many comments that did not have enough time to be presented at the conference should be sent in writing so that the Provincial Front could synthesize them and the Department of Natural Resources and Environment could continue to complete them.
It is expected that the draft Regulation on compensation, support and resettlement when the State acquires land in Quang Nam province will be submitted by the Provincial People's Committee to the Provincial People's Council in the upcoming session (expected to be held in mid-October 2024).
