Continuing the 9th Session, on the morning of May 17, with 416/443 delegates participating in the vote, the National Assembly passed the Resolution of the National Assembly on a number of special mechanisms and policies, creating breakthroughs in building and organizing law enforcement.
According to the Resolution of the National Assembly, people who directly and regularly do consulting work on strategy, policy research, and law making at a number of agencies and units are entitled to monthly support equal to 100% of their salary according to the current salary coefficient (excluding allowances).
This group includes: full-time National Assembly deputies; full-time provincial People's Council deputies; leaders, civil servants, and officers of the armed forces with positions in law-making, legislation, inspection of legal documents, resolution of international disputes, and researchers of agencies and units as prescribed.
Other subjects belonging to the Party and Vietnam Fatherland Front agencies as prescribed by the competent Party agencies; other subjects belonging to ministries, ministerial-level agencies and local authorities as prescribed by the Government; subjects not falling under the above points as prescribed by the National Assembly Standing Committee are also groups entitled to receive monthly support.
According to the Resolution, the regulations on other subjects receiving monthly support must ensure that the correct subjects are those who directly and regularly do the work of advising on strategy research, policies, and law making, in accordance with the prescribed principles.
The above regime does not apply to those holding positions of Deputy Minister and equivalent or higher (except full-time National Assembly Deputies and full-time Provincial People's Council Deputies). The monthly support is paid with the salary and is not used as a basis for calculating social insurance contributions and benefits.
Income from law-making work as prescribed in this Resolution is exempt from personal income tax and other financial obligations to the State.
Reporting on the reception, explanation and revision of the draft Resolution before the National Assembly votes to approve it, Minister of Justice Nguyen Hai Ninh said that many opinions suggested adding beneficiaries of monthly support equal to 100% of the current salary coefficient, which are full-time provincial People's Council delegates and leaders and civil servants directly assisting the Office of the National Assembly Delegation and the provincial People's Council in drafting legal documents of the provincial People's Council.
Regarding this issue, the Government accepts and supplements the beneficiaries of monthly support equal to 100% of the current salary coefficient, which is full-time provincial People's Council delegates.
According to Mr. Nguyen Hai Ninh's explanation, this is a group of cadres who basically ensure the criteria of "directly and regularly doing policy advisory work and law making" stipulated in Resolution No. 66 of the Politburo and proposed by many National Assembly delegates.
In addition, the Minister of Justice stated that he has not yet considered and immediately added a number of other subjects proposed by delegates because these subjects were discussed during the process of drafting the Resolution but have not yet achieved high consensus among the agencies.
" Therefore, the draft Resolution is completed in the direction of assigning competent agencies of the Party, the National Assembly Standing Committee, and the Government to continue reviewing, adjusting, and supplementing later on the basis of ensuring the correct subjects according to regulations ," said Mr. Nguyen Hai Ninh.
Also in the recently passed Resolution, the National Assembly agreed to ensure that spending on law-making is not less than 0.5% of the total annual budget expenditure and gradually increase according to development requirements. Thus, it is expected to spend about 12,500 billion VND each year. The National Assembly also agreed to stipulate that the Fund for supporting policy and law development is a non-budgetary state financial fund with legal status, under the Ministry of Justice, operating not for profit. The Fund aims to support and finance projects, tasks, and activities that are not funded by the state budget or need additional funding to create breakthrough, positive, effective, and sustainable changes in law-making. The Fund is guaranteed charter capital by the State from the State budget as prescribed in this Resolution; and is allowed to receive legal support sources outside the State budget from domestic organizations and individuals. The Resolution takes effect from July 1. |
