The National Assembly passed the Law amending and supplementing a number of articles of the Law on Product and Goods Quality.
Previously, Member of the National Assembly Standing Committee, Chairman of the Committee for Science , Technology and Environment Le Quang Huy presented a report explaining, accepting and revising the draft Law amending and supplementing a number of articles of the Law on Product and Goods Quality.
Mr. Le Quang Huy said that after receiving and revising, the draft Law consists of 3 Articles, 27 clauses; amending 29 Articles, adding 14 new Articles, removing 34 Articles, 3 clauses of 02 Articles.
Classification of products and goods based on risk level
Regarding the principles of classification and management of product and goods quality (Clause 1, Article 1, amending and supplementing Article 5 of the Law on Product and Goods Quality), there are opinions suggesting reviewing regulations according to international practices on risk management, ensuring that the transition from managing goods based on safety risks to managing goods based on risk levels does not hinder business operations.
In response to the opinions of National Assembly deputies, the draft Law has reviewed, revised and supplemented regulations on classifying products and goods based on risk levels (Clause 1, Clause 2, Article 5) to conform to international practices on risk management.
At the same time, supplement the principles of product and goods quality management (Clause 4, Article 5) to ensure the shift from managing goods based on safety risks to managing goods based on risk levels and assign the Government to provide detailed regulations (Clause 5, Article 5).
Regarding the responsibility for State management (Clause 1, Article 1 supplementing Article 6a of the Law on Product and Goods Quality), there are opinions suggesting continuing to review specific provisions in the draft Law related to the responsibility of the Ministry of Science and Technology and ministries and branches in state management of product and goods quality; minimizing the regulation of specific responsibilities, tasks and powers of ministries and branches in the draft Law, but assigning the Government to specify in detail according to its authority, ensuring the principle that each task is assigned to only one agency to implement and take full responsibility within the scope of the sector and field under its management.
According to Chairman of the Committee for Science, Technology and Environment Le Quang Huy, in response to the above comments, the draft Law has been reviewed and revised to clearly stipulate that the Ministry of Science and Technology is responsible to the Government and the Prime Minister for the unified implementation of state management of product and goods quality. The responsibility of ministries and branches is assigned to the Government for detailed regulations (Clause 3, Article 6a).
Particularly for products and goods in the fields of national defense, security, cryptography, ensuring secrets, and national security, which have their own characteristics, the draft Law specifically stipulates the responsibilities of the Minister of National Defense and the Minister of Public Security to be consistent with their authority. Therefore, the Standing Committee of the National Assembly proposes to keep the provisions as in the draft Law.
Regarding national quality infrastructure (NQI) (Clause 1, Article 1, supplementing Article 6b of the Law on Product and Goods Quality, there are opinions suggesting to study and clarify the content of national quality infrastructure; suggesting to select appropriate and necessary contents to stipulate principles in the Law, at the same time clearly defining the responsibilities of state agencies, the roles and participation of enterprises and economic sectors in building Vietnam's NQI; reviewing to ensure consistency with the draft Law on Standards and Technical Regulations being submitted to the National Assembly for consideration and approval at the 9th Session.
Regarding this content, the National Assembly Standing Committee reported as follows: National quality infrastructure (NQI) is a system of legal and technical mechanisms to implement standards, measurement, conformity assessment (including accreditation), inspection and policy development activities in each country to meet the requirements of domestic socio-economic development, promote international recognition to support businesses to participate in the global supply chain of goods and services.
In response to the opinions of the National Assembly Deputies, the draft Law has been revised to only stipulate the key contents and tasks of a principled nature in the development of NQI; policies and State investment resources in building this system; identify key contents and tasks (Clause 2, 3, 4, Article 6b) and assign the Government to specify these contents in detail (Clause 5, Article 6b). At the same time, to ensure consistency with the Law amending and supplementing a number of articles of the Law on Technical Standards and Regulations, the content on NQI is only stipulated in the draft Law on Product and Goods Quality to facilitate its application.
Regarding the application of technology in product and goods quality management (Clause 1, Article 1 supplementing Article 6d of the Law on Product and Goods Quality), there are opinions suggesting the addition of regulations on the organization, construction, management and development of data to serve the requirements of digital transformation, application of technology for management and development creation. In response to the above opinions, the draft Law has reviewed and revised this content, shown in Article 6d, Article 6d and assigned the Government to specify in detail (Clause 5, Article 6d).
There are suggestions for more specific regulations on technology application in product and goods quality management, clarifying the key content in science and technology application, support mechanisms (finance, technology, tax...), support approaches, roadmap and implementation mechanisms.
Regarding this content, the National Assembly Standing Committee said that the regulations on technology application in product and goods quality management are detailed and specific contents, therefore, the draft Law assigns the Government to provide detailed regulations (Clause 5, Article 6d) to properly implement the policy of decentralization and delegation of power in law-making and ensure flexibility in implementation.
