Detailed regulations on the objectives and functions of the National Housing Fund

According to Decree No. 302/2025/ND-CP, the Government established the Central Housing Fund under the Ministry of Construction, assigned to the Ministry of Construction for management; Provincial People's Committees established and managed local housing funds.

The Government has just issued Decree No. 302/2025/ND-CP dated November 19, 2025 detailing the National Housing Fund and measures to implement Resolution No. 201/2025/QH15 dated May 29, 2025 of the National Assembly on piloting a number of specific mechanisms and policies for social housing development.

The Decree consists of 7 chapters and 27 articles regulating the establishment, legal status, operation and financial management of the National Housing Fund (hereinafter referred to as the Fund); receiving, managing and using support and contributions from domestic and foreign organizations and individuals; investment activities, creation, management and operation of housing rental; inspection of operations; responsibilities of the Fund and ministries, branches and localities.

Establishment of the National Housing Fund

The Decree stipulates the establishment of the National Housing Fund specifically as follows: The Government establishes the Central Housing Fund under the Ministry of Construction , and assigns the Ministry of Construction to manage it.

The Provincial People's Committee establishes and manages the local housing fund.

The financial management mechanism of the Fund is implemented according to the provisions of this Decree and the provisions of law on public service units.

The Provincial People's Committee decides on the establishment or reorganization or assignment of existing financial funds managed by the Provincial People's Committee, but must ensure operations in accordance with the provisions of Resolution No. 201/2025/QH15 and this Decree.

Specifically, the newly established local housing fund is a public service unit, implemented in accordance with the provisions of this Decree and relevant laws. In case of reorganizing an existing financial fund, the Provincial People's Committee shall decide on the operating model as a public service unit or the current model of the fund and implement the objectives and operational functions of the fund in accordance with the provisions of Article 5 of this Decree.

In case the Provincial People's Committee decides to assign an existing financial fund to implement the objectives of the Local Housing Fund, the fund shall continue to implement the fund's operating model and supplement the fund's objectives and operational functions as prescribed in Article 5 of this Decree.

The Fund specified in Point b and Point c of this Clause is responsible for the operation of the Local Housing Fund and is not allowed to use the Fund's operating capital to perform tasks other than the Fund's operational objectives; and shall separately account for and monitor the Fund's operating capital.

The legal status, legal entity status, organizational structure, financial and management regime, asset use, reporting and accounting regime for the local housing fund that is not a public service unit shall continue to be implemented according to the fund's current operating model.

The National Housing Fund is a public service unit. The Fund is established, organized, reorganized, operated and dissolved in accordance with the provisions of this Decree and relevant laws corresponding to its operating model. The Fund has legal status, its own seal, independent accounting, charter capital, and is allowed to open accounts at the State Treasury and commercial banks.

Objectives and functions of the Fund

The objectives and functions of the Fund are stipulated as follows:

Creating social housing through the form of receiving and converting the function of public property houses according to the provisions of the law on housing and related laws for rent.

Creating houses and social houses through the form of purchasing from investors; ordering, receiving, transferring houses and social houses from enterprises in which the State holds 100% of the charter capital; receiving houses for resettlement and temporary residence; receiving and transferring houses and social houses from organizations and individuals who voluntarily contribute for rent.

Creating housing through the form of purchasing commercial housing for rent to officials, civil servants, public employees, and workers.

Organization of management and operation of housing built and created by the Investment Fund for rent according to regulations.

Duties and powers of the Fund

The Fund performs tasks in accordance with its operational objectives; manages and uses state budget funds and other legal sources in accordance with the provisions of this Decree and regulations related to the Fund's operations.

Manage and use effectively and for the right purposes the capital, land and assets assigned by the State or created during the Fund's operation; implement the reporting, financial management, accounting, auditing regimes and regulations related to the Fund's operations as prescribed in this Decree and relevant legal provisions; be subject to inspection, examination and audit of the Fund's financial activities as prescribed by law; implement the financial revenue and expenditure regime as prescribed by law for public service units.

Powers of the Fund

Organize activities, receive state budget capital, other legal capital sources and assets; conduct joint ventures and associations according to the provisions of this Decree, regulations for public service units and relevant legal provisions.

Coordinate with relevant agencies and units to carry out the Fund's activities in accordance with assigned functions and tasks as prescribed by law.

Refuse to provide information or use the Fund's resources if such request is contrary to the provisions of law and the Fund's operations.

Organizational structure of the Fund

The Decree stipulates the organizational structure of the Fund in accordance with the provisions of law for public service units, including the Fund Director, no more than 2 Deputy Directors, Chief Accountant and no more than 5 department-level units performing administrative and professional functions.

The Director and Deputy Director of the Central Housing Fund are appointed and dismissed by the Minister of Construction.

The Director and Deputy Director of the Local Housing Fund are appointed and dismissed by the Chairman of the Provincial People's Committee.

The Fund Director is the legal representative of the Fund; fully responsible before the law and the Minister of Construction for the Central Housing Fund, and the Chairman of the Provincial People's Committee for the local Housing Fund./.
