REGULATIONS ON SPECIALIZED AGENCIES UNDER PROVINCIAL PEOPLE'S COMMITTEES
Structure and functions of the Department
The Decree stipulates that the Department is a specialized agency under the Provincial People's Committee. The Department has legal status, its own seal and account in accordance with the law; performs the function of advising and assisting the Provincial People's Committee in state management of sectors and fields in the locality in accordance with the law.
The Department is responsible for submitting to the Chairman of the Provincial People's Committee draft documents under the authority of the Chairman of the Provincial People's Committee as assigned; organizing the implementation of legal documents, planning, and plans after approval; informing, propagating, guiding, disseminating, educating, and monitoring the enforcement of laws in the fields under the assigned state management scope; organizing the implementation and being responsible for appraisal, registration, granting of licenses, diplomas, and certificates under the management scope of the provincial specialized agency according to the provisions of law; managing according to the provisions of law for enterprises, collective economic organizations, private economic organizations, associations, and non-governmental organizations within the scope of the sector and field; managing the activities of public and non-public career units within the scope of the sector and field...
Provinces and cities are organized with no more than 14 departments.
The organizational structure of the Department includes: Professional and technical departments; Office (if any); Branches and equivalent organizations (if any); Public service units (if any).
Article 8 of Decree 50/2025/ND-CP stipulates that the departments are organized uniformly in localities, including: 1- Department of Home Affairs; 2- Department of Justice; 3- Department of Finance; 4- Department of Industry and Trade; 5- Department of Agriculture and Environment; 6- Department of Construction; 7- Department of Science and Technology; 8- Department of Culture, Sports and Tourism; 9- Department of Education and Training; 10- Department of Health; 11- Provincial Inspectorate; 12- Office of the People's Committee.
Article 9 of Decree 50/2025/ND-CP stipulates that specific departments are organized in some localities, including: 1- Department of Foreign Affairs; 2- Department of Ethnic Minorities and Religions; 3- Department of Tourism ; 4- Department of Planning and Architecture established in Hanoi and Ho Chi Minh City.
The Decree also clearly states that based on the provisions of Articles 8 and 9 of this Decree, provinces and cities are allowed to have no more than 14 departments, with Hanoi and Ho Chi Minh City having no more than 15 departments.
One-level Public Administration Service Center under the Provincial People's Committee shall comply with Government regulations.
SPECIALIZED AGENCIES UNDER THE PEOPLE'S COMMITTEE AT COMMUNE LEVEL
Location and function of the room
The Decree stipulates that the department is a specialized agency under the People's Committee at the commune level; performing the function of advising and assisting the People's Committee at the commune level in state management of sectors and fields in the locality according to the provisions of law.
The Department under the People's Committee at the commune level is subject to the direction and management of the organization, job positions, civil servant payroll, civil servant rank structure, number of employees, staff structure according to professional titles in public service units and the work of the People's Committee at the commune level, and is subject to the direction, inspection and guidance on professional expertise of the specialized agency under the People's Committee at the provincial level.
The Department is responsible for organizing the implementation of legal documents, planning, and plans after approval; informing, propagating, disseminating, and educating about laws in the fields under its assigned management scope; monitoring law enforcement; assisting the People's Committee at the commune level in implementing and taking responsibility for the appraisal, registration, and issuance of licenses, certificates, and other equivalent documents within the scope of responsibility and authority of specialized agencies according to the provisions of law and as assigned by the People's Committee at the commune level; assisting the People's Committee at the commune level in state management of collective economic organizations, private economic organizations, associations, and non-governmental organizations operating in the area under the management fields of specialized agencies according to the provisions of law; organizing the application of scientific and technological advances; building information systems, innovation and digital transformation, and archiving to serve the state management and professional work of specialized agencies at the commune level...
Commune level has 3 specialized departments
Article 15 of Decree 50/2025/ND-CP stipulates that specialized departments organized at the commune level include:
1- The Office of the People's Council and People's Committee advises and assists the People's Committee at the commune level in performing state management functions in the following areas: Office; Justice; Foreign Affairs.
2- The Economic Department (for communes and special zones) or the Economic, Infrastructure and Urban Department (for wards and Phu Quoc special zones) advises and assists the People's Committee at the commune level in performing state management functions in the following areas: Finance - Planning; Construction and Industry and Trade; Agriculture and Environment.
3- The Department of Culture and Society advises and assists the People's Committee at the commune level in performing the state management function in the fields of: Internal Affairs; Education and Training; Culture, Science and Information; Health.
The Decree clearly states that, based on the provisions of Article 15 of this Decree and the requirements for state management of sectors and fields at the local level, local authorities at the commune level decide on the establishment of specialized departments.
The Public Administration Service Center under the People's Committee at the commune level operates according to Government regulations.
Responsibilities of the People's Committees at provincial and communal levels
In addition, the Decree also clearly stipulates the responsibilities of the People's Committees at provincial and commune levels.
The responsibilities of the provincial People's Committee include: Specifying the functions, tasks and powers of each department in accordance with the guidance of the ministry managing the sector and field; deciding on the organizational structure and number of Deputy Directors of each department in accordance with the requirements of state management of the sector and field in the locality and the criteria prescribed in this Decree; regulating the functions, tasks, powers and organizational structure of branches and public service units under the department in accordance with the provisions of this Decree, except in cases where specialized laws provide otherwise.
The People's Committee at the provincial level decides to establish, reorganize, and dissolve public service units under the Department according to the provisions of law, ensuring compliance with the planning of the network of public service units by sector and field approved by competent authorities, guidance of the sector and field management ministry and the Ministry of Home Affairs; decentralize and authorize the implementation of one or several tasks and powers under the authority of the People's Committee at the provincial level according to the provisions of law...
