Regulations on the age of children wearing helmets when participating in traffic

Specifically, at point o, clause 3, Article 6 of Decree 100, regulations on penalties for vehicle drivers if they carry people without wearing helmets or wearing helmets but not fastening the straps properly.

However, there is an exception to this rule for children under 6 years old. This means that children aged 6 and above are required to wear helmets when participating in traffic. Failure to comply with this rule will result in a fine of VND400,000 to VND600,000 for the driver.

If a child under 6 years old is not wearing a helmet, the driver will not be fined, because the regulation does not apply to this age group. Why should children wear helmets even though it is not mandatory?

Penalty for carrying children over 6 years old without helmets

According to Decree 100/2019/ND-CP and Decree 123/2021/ND-CP, drivers of vehicles carrying children over 6 years old without wearing helmets will be fined from 400,000 VND to 600,000 VND. This is one of the measures to raise awareness of traffic participants about complying with safety regulations.

In addition to the act of transporting children without wearing helmets, other violations such as changing direction without reducing speed, carrying more people than the prescribed number, or not driving in the correct lane... can also be punished according to the current traffic law framework.

Types of helmets according to standards

According to National Standard TCVN 5756:2017, helmets for motorbike riders are divided into 4 types as follows:

- Half-head helmet: Commonly used, usually compact, suitable for urban travel conditions.

- Three-quarter head cover: Better coverage, protects the head and neck.

- Helmet covers both head and ears: Ensures comprehensive safety for the driver.

- Helmet covers the entire head, ears and jaw: Often used by drivers of large displacement motorbikes or in racing activities.
