Review and complete draft decrees guiding the implementation of the Land Law

This morning, June 18, in Hanoi , Deputy Prime Minister Tran Hong Ha chaired an online meeting with ministries, branches, central agencies and localities to review, absorb and complete the draft decrees: Detailed regulations on the implementation of a number of articles of the Land Law; Regulations on compensation, support and resettlement when the State recovers land; Regulations on basic land survey; Registration and issuance of certificates of land use rights, ownership of assets attached to land and land information system.

These draft decrees have been received and completed by the drafting agency (Ministry of Natural Resources and Environment) according to comments from members of the Government , ministries, branches, localities, associations, businesses, experts... through meetings and documents to supplement and edit to ensure details, completeness, synchronization and consistency with the 2024 Land Law, as well as the system of other relevant legal documents; at the same time, ensuring inheritance, stability and development of the land law system.

On that basis, at this meeting, delegates focused on carefully reviewing all the contents that had been received, revised and commented on a number of inconsistent Articles and clauses of the draft Decree detailing the implementation of a number of articles of the Land Law. In particular, focusing on the content on planning; detailed regulations on the establishment, appraisal and approval of land use plans; settlement of land disputes, handling of violations of land law by violators when performing official duties in the land sector...

Representatives of some localities, based on the actual situation, contributed opinions on the criteria for allocating national land use indicators to localities for rice-growing land and for protective forest land. Regarding the draft Decree on Regulations on compensation, support, and resettlement when the State reclaims land and Registration and issuance of certificates of land use rights, ownership of assets attached to land and land information system, many opinions suggested clarifying major issues, such as: Establishing, appraising, and approving compensation, support, and resettlement plans; land compensation when the State reclaims non-agricultural land that is not residential land of households and individuals; funding and payment of compensation, support, and resettlement; land compensation when the State reclaims residential land; support and resettlement arrangement...

Notably, some opinions assessed that the draft decrees have institutionalized the Articles and Clauses in the Land Law related to decentralization, delegation of power, and assignment of responsibilities to provincial and district authorities in land management and use; at the same time, promoting reform and cutting administrative procedures to reduce time and costs for people and businesses.

Concluding the meeting, Deputy Prime Minister Tran Hong Ha emphasized that in order to ensure the substance and effectiveness of the review and consultation of draft decrees related to the 2024 Land Law, the Government has organized many meetings and directed the drafting agencies to seriously study and absorb on the basis of consistency between land law and other relevant legal provisions, promptly amend and supplement provisions that are not suitable to reality.

The Deputy Prime Minister assigned the Ministry of Natural Resources and Environment to fully synthesize the opinions discussed by delegates at the meeting; urgently coordinate closely with relevant ministries, branches, units and localities to complete the draft decrees to submit to the Government for consideration and decision so that the decrees, after being promulgated, are suitable to the actual situation, promote the effectiveness of the 2024 Land Law, contributing to the overall development of the country.
