Closing Ceremony of the First Lawmaking Forum

This afternoon, November 22nd, under the chairmanship of Politburo member and National Assembly Chairman Tran Thanh Man, the First Lawmaking Forum, themed "Improving institutions and laws to meet the requirements of national development in the new era," concluded successfully after a very urgent, serious, intellectual, and dedicated working session.

Contributing to further clarifying many aspects of the National Assembly 's legislative activities.

At the Forum, National Assembly Chairman Tran Thanh Man delivered an opening speech providing a comprehensive overview of the legislative work of the 15th National Assembly and outlining tasks and solutions to overcome difficulties and limitations in legislative work in the past, as well as tasks and solutions to further improve the quality of institutional and legal work in the future.

Deputy Prime Minister Ho Quoc Dung delivered a speech on the work of lawmaking and proposed practical and valuable solutions and recommendations for improving institutions and laws to meet the requirements of national development.

The forum viewed the video clip "Institutions and Laws Leading the Way - The Mark of the 15th National Assembly" ; listened to the Chairman of the Committee on Law and Justice present the introductory report to the forum. In addition, there were 20 papers submitted to the forum by agencies of the National Assembly, central and local ministries and departments, and universities; and there were also speeches, exchanges, and discussions by National Assembly delegates, representatives of agencies and organizations, research institutes, experts, and scientists directly at the forum.

In his closing remarks at the Forum, Central Committee member and Vice Chairman of the National Assembly Nguyen Khac Dinh - Deputy Head of the Forum's Organizing Committee - stated that the Forum's theme, " Improving institutions and laws to meet the requirements of national development in the new era ," attracted the attention of society, the people, the business community, as well as central and local news agencies and press.

The content of the presentations and opinions expressed at the Forum closely adhered to the Party's guidelines and policies on building and perfecting the socialist rule of law state in Vietnam in the new period, the strategic goals of the Party and the State, especially the spirit of the draft Resolution of the 14th National Congress of the Party, and were based on thorough and in-depth theoretical and practical research and summation.

"This has contributed to clarifying many issues and innovative contents in the legislative activities of the 15th National Assembly, the achievements, shortcomings, limitations, causes, lessons learned, requirements and solutions for continuing to strongly innovate the legislative activities of the National Assembly in the future, contributing to perfecting institutions and laws, meeting the requirements of national development in the new era," the Vice Chairman of the National Assembly stated.

Leveraging the role of "taking the lead in institutional reform" and responding promptly to practical demands.

Following discussions from various agencies and organizations, and the opinions of National Assembly deputies, experts, and scientists, Vice Chairman of the National Assembly Nguyen Khac Dinh emphasized that the First Lawmaking Forum achieved high consensus on many important contents and assessments:

Firstly, the legislative activities of the 15th National Assembly have undergone significant innovation in thinking and drafting processes, demonstrating proactiveness, creativity, and early preparation, playing the role of "taking a step ahead in institutional reform," promptly responding to new situations, and meeting the practical demands of life.

The policies enacted are centered around the people and businesses, actively addressing difficulties and obstacles, contributing to unleashing productive forces, and effectively mobilizing and utilizing all resources for national development.

In particular, in recent sessions, the draft laws passed by the National Assembly have ensured conciseness and clarity, only regulating issues within the National Assembly's jurisdiction, granting autonomy and flexibility, and creating favorable conditions for the Government in the implementation process; promoting decentralization, delegation of power, and administrative procedure reform. These results have made a significant contribution to the comprehensive achievements in socio-economic development, national defense, security, and foreign affairs of the country in recent years.

Secondly, our country's legal system has been increasingly perfected in recent years, achieving a number of outstanding results such as:

The work of building and perfecting the legal framework for the organization of state agencies towards streamlining, efficiency, effectiveness, and efficiency, promoting decentralization and delegation of power, and implementing the two-tiered local government model in accordance with the Party's policy must be carried out quickly, synchronously, and systematically, creating a solid legal foundation for the formation of a two-tiered local government model, linked with strong and synchronized decentralization and delegation of power, creating proactiveness for agencies and organizations in implementation.

Significant breakthroughs have been made in building and perfecting the institutional framework for science, technology, innovation, and digital transformation. Laws and resolutions issued have promptly removed obstacles and bottlenecks, creating a favorable legal framework for the development of science, technology, innovation, and digital transformation, unlocking financial and budgetary resources, and strongly supporting the science, technology, and innovation ecosystem.

The legal framework for a socialist-oriented market economy continues to be improved in a way that facilitates investment and business, unlocks social resources, and promotes economic development, especially the digital economy, green economy, and circular economy, to suit practical realities and meet the development requirements of a socialist-oriented market economy and international integration.

The work of perfecting the legal framework on culture and society has contributed to perfecting institutions, building and developing an advanced Vietnamese culture rich in national identity; creating a solid legal framework for developing high-quality human resources, enhancing national competitiveness, promoting international integration in education; improving the capacity of the health system, developing the pharmaceutical industry, basic medicine and preventive medicine, while ensuring social security and the rights of people in accessing quality healthcare services.

The legal system concerning national defense, security, and foreign affairs has been continuously improved, contributing to maintaining political stability, creating favorable conditions for the country's socio-economic development, and fostering continuous international integration in both breadth and depth.

Power is not adequately controlled, and responsibilities are not clearly and transparently defined.

Besides the outstanding achievements, Vice Chairman of the National Assembly Nguyen Khac Dinh also pointed out that the work of building and perfecting institutions still has many shortcomings and limitations, such as: the law still suffers from a situation where power is not fully controlled, and responsibilities are not clearly and transparently defined.

"For many years, decentralization and delegation of power have been considered central to administrative reform, but the results have not been as desired. New regulations on the development of science, technology, innovation, and national digital transformation lack some detailed guidelines, leading to confusion in the implementation process," the Vice Chairman of the National Assembly stated.

The legal system governing investment and business still contains overlapping and contradictory regulations, lacks clarity, and poses legal risks for businesses, especially in the area of ​​long-term investment. The current legal system lacks stability and predictability; the frequent issuance and amendment of legal documents, often without adequate impact assessments, creates difficulties for those implementing the regulations and for businesses in developing production and business plans and long-term strategies.

Institutional and policy frameworks in the cultural sector are slow to innovate; some social policies have not kept pace with economic development. Policies for training and developing human resources have not seen a breakthrough to meet the needs of society and the labor market, and the situation of "too many academics, too few skilled workers" in human resource development still persists. Some policies in the areas of pharmaceutical management, medical equipment, health insurance, and healthcare socialization lack consistency.

Focus on comprehensively and synchronously improving institutions for rapid and sustainable development.

Deputy Speaker of the National Assembly Nguyen Khac Dinh stated clearly at the Forum, Agencies, organizations, delegates, and experts have proposed five groups of tasks and solutions, both general and specific, that are very practical and aimed at further improving the legal system in the coming period.

Firstly, we must continue to vigorously innovate our thinking, promote strategic breakthroughs, create a new development ecosystem, and focus on comprehensively and synchronously perfecting institutions to ensure rapid and sustainable national development.

Secondly, the Standing Committee of the National Assembly focused on directing the development of the Legislative Orientation Project for the 16th National Assembly term, ensuring consistency and uniformity with the Project " Improving the structure of the Vietnamese legal system to meet the requirements of national development in the new era" prepared by the Ministry of Justice.

Thirdly, strengthen the control of power in the law-making process, prevent group interests and parochial interests in policy-making, and ensure that all decisions prioritize national interests, the interests of the people; regularly monitor, review, and evaluate the effectiveness of laws after their promulgation, and apply technology in receiving, responding to, and processing feedback and suggestions from citizens and businesses related to law enforcement.

"Policies enacted must be measurable by concrete results, control risks, and especially create favorable conditions without adding unnecessary procedures. Management should be based on law, but always with the aim of fostering development, both in lawmaking and law enforcement. If, after a period of time, the objectives are not achieved, their effectiveness must be reviewed, and they may need to be repealed or amended," the Vice Chairman of the National Assembly emphasized.

Fourth, implement synchronized, comprehensive, and decisive breakthrough solutions to create a fundamental transformation in the quality of human resources in the work of lawmaking and law enforcement, meeting the requirements of rapid and sustainable development of the country.

Fifth, in the context of digital transformation and the digital economy, digital data is being increasingly applied to all areas of national governance, and the work of improving institutions and laws cannot stand outside this international trend.

According to the Vice Chairman of the National Assembly, currently, our legal system is still being managed and operated using a traditional approach, while the rapid pace of document issuance, the complex interplay between different sectors, and the ever-increasing volume of legal documents create immense pressure on the National Assembly, the Government, and ministries, departments, and localities.

The issues of "overlapping, conflicting, inconsistent, and slow issuance of guiding documents" are consistently among the top causes of difficulties in law enforcement, hindering the investment and business environment, increasing compliance costs, and reducing the predictability of the economy.

"These bottlenecks cannot be resolved simply by amending individual laws or perfecting traditional legislative techniques; instead, it is necessary to shift the mindset of state governance from 'drafting legal documents' to 'designing and managing the legal system'," the Vice Chairman of the National Assembly pointed out.

In that spirit, the Vice Chairman of the National Assembly suggested that further research is needed on the application of information technology and digital transformation in lawmaking to help ensure that Vietnam's legal system is enacted and operated transparently, adopting advanced international methods, and ensuring greater smoothness and efficiency, as proposed by experts, scientists, and in discussions on the issue of "building machine-readable laws," considering this a breakthrough in institutional development and governance of national law.

Within a very short timeframe, the Forum was high-quality, lively, engaging, and captivating, with a wealth of useful information and insightful, responsible, and frank opinions expressed.

Deputy Speaker of the National Assembly Nguyen Khac Dinh assessed that the Forum has truly become a multi-directional and comprehensive information center, a place to share the voices of agencies involved in lawmaking at the central level, law enforcement agencies, localities, research institutes, universities, experts, and scientists.

The discussions at the Forum made a significant contribution to summarizing the term of the 15th National Assembly, as well as preparing for the development of legislative orientations for the 16th National Assembly term and reforming lawmaking during the 16th National Assembly term, in conjunction with reforming the structure of Vietnam's legal system, to meet the requirements of national development in the new era.

The forum also discussed the spirit of the National Assembly working alongside the Government, local authorities, and other agencies and organizations within the political system to jointly build and develop the country in accordance with the Party's guidelines and policies.

Immediately following the Forum, the Vice Chairman of the National Assembly stated that the Forum's Organizing Committee would compile a comprehensive report summarizing the Forum's results and send it to the National Assembly, the Government, central and local ministries and agencies to promptly serve the purpose of summarizing the term, researching and developing legislative orientations for the 16th National Assembly term and legislative programs for subsequent years, and for reference in the process of amending legal regulations in general, as well as in the process of formulating policies and orientations for socio-economic development, primarily laws, resolutions, and policy mechanisms, right in the Tenth Session of the National Assembly.
