Construction permits will be abolished in areas with 1/500 planning and urban design.

On the afternoon of June 4, at the regular Government press conference for May 2025, the press asked: "Recently, public opinion has been talking a lot about the possibility of abolishing construction permits for people's housing projects, so how will it be implemented in the near future?"

Responding to this content, Mr. Nguyen Danh Huy - Deputy Minister of Construction emphasized that the reduction of construction permit procedures is an issue raised by the Prime Minister in Official Dispatch 78. Currently, the Ministry of Construction is reviewing the entire system of legal documents regulating licensing, from the Construction Law, decrees and circulars issued by the Ministry of Construction.

The Ministry of Construction also conducted a final assessment because all construction permit procedures for people are currently decentralized to all localities.

"We must create maximum convenience for people and businesses, but we must also assess the impact of removing construction permits and allowing people to build on their own. Will it affect the legitimate rights and interests of other people and businesses?", Mr. Huy said.

Next, the Ministry of Construction will propose a roadmap to amend and reduce the Construction Law. These contents will be completed in 2025.

According to Mr. Huy, in the immediate future, areas with detailed planning 1/500, which has been approved, can amend the law to immediately exempt licensing. Along with that are areas that have been urban designed.

"These areas are already under the management of the State, so they should be abandoned immediately," Mr. Huy said, emphasizing that granting permission to abandon them would bring many benefits to the people and reduce costs for State agencies.

However, Mr. Huy emphasized that the cancellation of licensing must ensure the rights and legitimate interests of other surrounding households to avoid disputes.

Previously on May 22, in the Government's special meeting on law-making in May 2025, Prime Minister Pham Minh Chinh emphasized the view of resolutely cutting unnecessary administrative procedures. For example, in construction, the planning of height; the ratio of trees, the ratio of constructions; the distance between houses, between houses and sidewalks... are all regulated.

"Why do we have to force people to apply for permits? People have the right to use and build on land. The People's Committees of communes and wards are responsible for checking whether the construction is correct or not. Why do we have to force people to apply for permits?", the Prime Minister emphasized.

On May 29, Prime Minister Pham Minh Chinh signed Official Dispatch No. 78 on focusing on cutting and simplifying administrative procedures in the construction sector.

In the Official Dispatch, the Prime Minister requested the Minister of Construction to focus on implementing: Urgently review, cut, and simplify 361 administrative procedures related to production and business activities, 447 business conditions under the management of the Ministry of Construction, ensuring a reduction of at least 30% of the time to handle administrative procedures, 30% of the cost of complying with administrative procedures, and 30% of business conditions in 2025, with attention paid to researching, reviewing, cutting, and strongly simplifying administrative procedures in the construction sector.

Reduce construction permit procedures for construction projects with detailed planning at a scale of 1/500 or projects in areas with approved urban design.

The Prime Minister assigned the Minister of Construction to continue studying the thorough decentralization of authority to handle administrative procedures on project appraisal, design, construction permit issuance, and inspection of acceptance work, in accordance with the arrangement of administrative units and the implementation of the two-level local government organization model.
