On the morning of June 4, continuing the 46th session, the National Assembly Standing Committee gave opinions on receiving, explaining, and revising the draft Law amending and supplementing a number of articles of the Law on Advertising.

Reporting on a number of important issues regarding the reception, explanation and revision of the draft Law, Chairman of the National Assembly's Committee on Culture and Society Nguyen Dac Vinh said that the Standing Committee of the Committee believes that entities participating in advertising activities must be responsible for providing information when requested by competent state agencies with different information contents, in accordance with the responsibilities of each entity.
Regarding the proposal to add joint liability for compensation, the draft Law has specifically stipulated the rights and obligations of organizations and individuals in the advertising activity chain.
Mr. Nguyen Dac Vinh said that to advertise a product, there are many entities involved and each entity is responsible for fulfilling its obligations when participating in advertising activities. When there is a violation, depending on the nature and extent of the violation, it will be subject to the corresponding form of handling.

In response to the proposal to tighten regulations on influencers who deliver advertising products, in the direction that only those with expertise related to the product can deliver advertising products, the Standing Committee of the Committee stated that in the market mechanism, the participation of celebrities in advertising activities is a commercial activity with positive significance, contributing to promoting production, business, economic development, and encouraging innovation in advertising activities.
“The law on food safety also specifically regulates advertising activities of medical facilities and medical staff… Therefore, the draft law requests to keep the provision of not restricting advertising for influential people,” said the Chairman of the National Assembly’s Culture and Social Affairs Committee.
Mr. Nguyen Dac Vinh also said that it is necessary to add specific and clear regulations on the rights and obligations of those who deliver advertising products, in order to overcome the situation where some celebrities and influencers advertise falsely, advertise fake and counterfeit goods. In particular, the obligation to "verify the credibility of the advertiser" is to increase the responsibility of those who deliver advertising products to the community and society.

Discussing at the meeting, Chairman of the National Assembly Delegation Work Committee Nguyen Thanh Hai said that at the discussion session on amending the Session Rules at the first session of the ninth session, there was an opinion proposing to ban National Assembly deputies from wearing costumes and accessories with business logos, commercial slogans or personal symbols, which can easily cause misunderstandings about representative interests...
“As the Chairman of the Delegation Affairs Committee, I am also very concerned about this issue. Is the above issue included in advertising activities? Is wearing costumes and accessories with the logo of National Assembly deputies when speaking in the hall considered advertising?”, the Chairman of the Delegation Affairs Committee said that this not only appeared during the session but also when meeting voters.
Regarding the concerns of Chairman of the National Assembly Delegation Affairs Committee Nguyen Thanh Hai, speaking to clarify this issue, Minister of Culture, Sports and Tourism Nguyen Van Hung affirmed that using costumes with business logos is not an advertising activity.
"Advertising activities are only possible when there is an agreement or contract between parties with commercial and communication elements," the Minister emphasized.
