New Year 2024, how many consecutive days off will workers get?

Article 112 of the 2019 Labor Code specifically regulates holidays and Tet for employees working in Vietnam.

Accordingly, employees are entitled to take a day off with full pay on the following holidays: New Year's Day is 1 day off (January 1); Lunar New Year is 5 days off; Victory Day is 1 day off (April 30); International Labor Day is 1 day off (May 1); National Day is 2 days off (September 2 and 1 day before or after); Hung King's Commemoration Day is 1 day off (March 10 of the lunar calendar).

In 2024, New Year's Day falls on Monday, January 1, 2024. Thus, on New Year's Day 2024, employees will have 1 day off and receive full pay.

However, December 30 and 31 fall on Saturday and Sunday. Therefore, during the 2024 New Year holiday, officials, civil servants, public employees and workers at state agencies will have a three-day holiday.

For employees with 2 days off per week (Saturday, Sunday), on New Year's Day they will have 3 consecutive days off, including 2 weekly days off (Saturday, Sunday) and 1 holiday (Monday).

If working at a unit with a one-day-off-weekly regime (Sunday), employees will have a 2-day consecutive New Year's holiday in 2024, from December 31, 2023 to January 1, 2024.

According to Article 104 of the 2019 Labor Code, a bonus is an amount of money or property or other forms that an employer rewards an employee based on the production and business results and the employee's level of work completion.

The bonus regulations are decided by the employer and publicly announced at the workplace after consulting with the employee representative organization at the workplace where there is an employee representative organization at the workplace.

It can be seen that if the business is doing well, it can reward its employees with large amounts of money. If the business situation is not good, the business can reward its employees with little or even no money.

According to Article 112 of the 2019 Labor Code, on the occasion of New Year 2024, employees are entitled to take a day off and receive full salary.

Due to work requirements, the company may proactively ask employees to work on New Year's Day. This will be considered overtime.

According to Article 107 of the 2019 Labor Code, employees are only required to go to work on New Year's Day if they agree.

When agreeing to work, employees will be paid overtime according to the provisions of Article 98 of the 2019 Labor Code as follows: Working during the day of New Year's Day will be calculated at an additional 300% of the salary of a normal working day; working at night on New Year's Day will be calculated at an additional 390% of the salary of a normal working day.
