Provincial Inspectorate dialogues to resolve complaints of 5 citizens

On the morning of June 27, implementing the direction of the leaders of An Giang Provincial People's Committee, Deputy Chief Inspector of An Giang Province Khuu De Danh chaired the second dialogue to resolve complaints regarding cases in which the Provincial People's Committee concluded to accept the proposal of the Provincial Inspectorate.

Mr. Huynh Van Tung and Mr. Phan Bui Minh Thuc (residing in Binh Khanh Ward, Long Xuyen City) complained about Decision 917/QD-UBND, dated September 28, 2017 of the People's Committee of Long Xuyen City, requesting consideration of allocating 1 resettlement plot, related to the An Giang Cardiovascular Hospital Expansion Investment Project. They said that it is necessary to reconsider the fact that 2 other households in the same situation were allocated resettlement plots, this is an inappropriate point.

After listening to the explanations and analysis of relevant units and localities, Deputy Chief Inspector of An Giang Province Khuu De Danh said that the irrigation collective housing area is a state-owned housing area, built by the Department of Irrigation in 1987 to provide stable accommodation for officials and civil servants. When the housing area was cleared to implement the An Giang Cardiovascular Hospital expansion investment project, households were only supported to arrange new accommodation themselves, and resettlement was not carried out according to the compensation plan approved by the Provincial People's Committee under Decision 2858/QD-UBND, dated September 28, 2017. The Long Xuyen City People's Committee provided financial support to 2 households in accordance with regulations. The complaints and requests for consideration of resettlement land allocation have no basis for resolution.

Provincial Inspectorate Verification Team gives opinions

The Provincial Inspectorate agreed to report to the Provincial People's Committee in the direction of maintaining Decision 1694/QD-UBND, Decision 1695/QD-UBND, dated February 25, 2025 of the Chairman of the City People's Committee to resolve the complaints of Mr. Tung and Mr. Thuc, rejecting the request to buy resettlement land. However, the People's Committee of Long Xuyen City will inspect and review the settlement of the sale of land to the two households TKH and TVT, and handle it according to its authority appropriately, avoiding comparisons and complaints from the households.

Mr. Huynh Tai Phu

Mr. Huynh Tai Phu (residing in My Hoa ward) was supported with nearly 200 million VND (in 2023), an additional support of 14.8 million VND (in 2024), and was allowed to buy a resettlement house plot in the resettlement area of ​​the Vietnam Urban Upgrading and Expansion Project - Long Xuyen City Sub-project, with a land use fee of over 12 million VND/ m2 . Mr. Phu filed a complaint requesting a reduction in the selling price to 6.5 million VND/ m2 , or consideration for installment payment within 5 years.

According to the verification results of the Provincial Inspectorate, Mr. Phu's household is not eligible for resettlement land allocation because the recovered land is perennial land owned by Mr. Huynh Van Trien (Mr. Phu's father); the City People's Committee has compensated Mr. Trien for the land. Therefore, the City People's Committee's decision to allocate resettlement land to Mr. Phu is not in accordance with regulations.

The Provincial Inspectorate reported to the Chairman of the Provincial People's Committee to request the People's Committee of Long Xuyen City to cancel Decision 3177/QD-UBND, dated April 3, 2025 of the Chairman of the People's Committee of Long Xuyen City; partially amend Decision 2489/QD-UBND, dated March 22, 2024 regarding the content "allowed to buy 1 resettlement house plot..."; reject Mr. Phu's complaint request.

Regarding the project to create land fund to build the An Giang Province Sports Training, Coaching and Competition Center (in My Hoa Ward, My Phuoc), Mr. Truong Van De and Ms. Le Au Kieu Trang (residing in My Xuyen Ward) requested to collect land use fees for the resettlement area (Component 3) according to Decision 39/2023/QD-UBND, dated October 31, 2023 of the Provincial People's Committee, not to apply the land price adjustment coefficient (coefficient K) according to Decision 11/2023/QD-UBND, dated March 30, 2023 of the Provincial People's Committee.

The Provincial Inspectorate found that the complaint of Mr. De and Ms. Trang was well-founded. Therefore, it will report to the Chairman of the Provincial People's Committee to resolve the second complaint in the following direction: Requesting the Chairman of the Long Xuyen City People's Committee to issue a Decision to cancel Decision 3178/QD-UBND, dated April 3, 2025, resolving the first complaint; re-settle the content of Mr. De and Ms. Trang's complaint in accordance with regulations; inspect and review the compensation, support and resettlement policies implemented with them to resolve the complaint in accordance with regulations, especially ensuring the deadline.

Regarding the implementation of the Project to create a land fund to build the Detention Camp of An Giang Provincial Police (in Binh Duc Ward), Ms. Dang Hai Le Khanh (residing in Binh Khanh Ward) requested to increase the compensation price for rice land (LUC) from 511,000 VND/ m2 to 14 million VND/ m2 (later reduced to 11 million VND); or exchange the nearby land area, frontage, and flat area similar to the current land status.

According to the Provincial Inspectorate Verification Team, the compensation price for the households to be cleared (including Ms. Khanh's household) was built in accordance with the land price at the time of land acquisition, approved by the Long Xuyen City People's Committee in Decision 5215/QD-UBND, dated June 24, 2024. The City People's Committee compensated and supported the recovered land area according to the approved plan in accordance with regulations. Her request for land exchange was well-founded, but the City People's Committee could not implement it because there was no land with the same purpose in the project.

The Provincial Inspectorate reported to the Chairman of the Provincial People's Committee to resolve Ms. Khanh's second complaint in the following direction: Maintain the content of Decision 1697/QD-UBND, dated February 25, 2025 of the Chairman of the Long Xuyen City People's Committee to resolve the first complaint; reject her request to increase land compensation price or land exchange.
