Registration and issuance of Certificates for land plots with increased area due to boundary changes compared to the issued Certificates
(1) Implementation sequence:
Step 1: The applicant submits the application to one of the following provincial agencies: Public Administration Service Center or Land Registration Office or Branch of Land Registration Office.
When submitting the required documents, the applicant can choose to submit a copy of the document and present the original for the officer receiving the application to check and compare, or submit the original document or submit a notarized or certified copy of the document in accordance with the law on notarization and certification; in case of submitting the application online, the application must be digitized from the original or a notarized or certified copy of the document.
In case of submitting copies or digitized versions of documents, when receiving the results of administrative procedure settlement, the applicant must submit the original documents of the dossier components according to regulations.
In case of confirming changes on the issued Certificate, the applicant must submit the original issued Certificate.
Step 2: The agency receiving the application shall:
- Check the completeness of the application components and issue a Certificate of Application Receipt and schedule a return of results.
In case the application is incomplete, the application will be returned with a Request for Additional Information and Document Completion Form for the applicant to complete and supplement according to regulations.
- In case the Public Administration Service Center receives the dossier, it will transfer the dossier to the Land Registration Office or the Branch of the Land Registration Office.
Step 3:
a) In case the original land plot has a Certificate, the additional land area due to receiving the transfer of the right to use a part of the land plot has been granted a Certificate, the Land Registration Office or Branch of the Land Registration Office shall:
- Notify the transferor in writing and post at the headquarters of the People's Committee of the commune where the land is located about the procedures for granting the Certificate to the transferee. In case the address of the transferor is unknown for notification, the notice shall be posted 3 times in the local mass media, the cost of posting shall be paid by the person requesting the Certificate.
- After 30 days from the date of first notice or publication in local mass media without a request for dispute resolution, the following shall be implemented:
+ Check the conditions for exercising rights according to the provisions of the Land Law for cases of exercising rights of land users and owners of assets attached to land; in cases where the conditions for exercising rights are not met, notify the reason and return the application to the person requesting registration.
+ Check and approve the cadastral map excerpt in case the land user submits a cadastral map excerpt of the land plot to re-determine the dimensions of the edges and area of the land plot.
+ Extract of cadastral map or extract of cadastral map of land plot for places where there is no cadastral map or only a torn or damaged paper cadastral map in case the issued Certificate has not used the cadastral map or has not used the extracted cadastral map of land plot and the land user needs to be re-issued a Certificate of land use rights, ownership of assets attached to land or is in a case where a new Certificate of land use rights, ownership of assets attached to land must be issued.
- Send the Information Transfer Form to determine financial obligations on land according to Form No. 19 issued with Decree No. 151/2025/ND-CP to the tax authority to determine and notify the collection of financial obligations in cases where financial obligations must be performed according to the provisions of law.
- Edit and update changes in land records and land database.
- Issue a new Certificate or confirm changes to the issued Certificate in cases where financial obligations are not required to be fulfilled; hand over the Certificate or send it to the dossier receiving agency to hand over to the grantee.
In case of having to fulfill financial obligations, perform the tasks specified in this point after receiving notice from the tax authority on the completion of financial obligations.
In case of a request for dispute resolution, the parties shall be instructed to submit the request to the competent state agency to resolve the dispute according to regulations.
b) In case the original land plot has a Certificate, the additional land area has not been granted a Certificate:
b1) The Land Registration Office or the Branch of the Land Registration Office shall transfer the dossier to the People's Committee of the commune where the land is located so that the People's Committee of the commune can organize the implementation of the following tasks for the increased land area:
- Confirm the current status of land use with or without housing, construction works; status of land disputes, assets attached to land, stable land use; in case there are no documents on land use rights, confirm the origin of land use.
- Checking compliance with planning for cases requiring compliance with planning to issue Certificates.
- Publicly post the inspection results according to Form No. 17 issued with Decree No. 151/2024/ND-CP at the headquarters of the People's Committee at the commune level and residential area where the land is located for 15 days, and at the same time consider and resolve comments on the publicly disclosed content (if any).
- Transfer the dossier with written results to the Land Registration Office or Branch of the Land Registration Office.
b2) Land registration office and branches of land registration office shall:
- Check and approve the cadastral map excerpt in case the land user submits a cadastral map excerpt of the land plot to re-determine the dimensions of the edges and area of the land plot.
- Extract of cadastral map or extract of cadastral map of land plot for places where there is no cadastral map or only a torn or damaged paper cadastral map in case the issued Certificate has not used the cadastral map or has not used the extracted cadastral map of land plot and the land user needs to be re-issued a Certificate of land use rights, ownership of assets attached to land or is in a case where a new Certificate of land use rights, ownership of assets attached to land must be issued.
- Send an Information Transfer Form to determine financial obligations on land according to Form No. 19 issued with Decree No. 151/2025/ND-CP.
- Edit and update changes in land records and land database.
- Issue a new Certificate or confirm changes to the issued Certificate in cases where financial obligations are not required to be fulfilled; hand over the Certificate or send it to the dossier receiving agency to hand over to the grantee.
In case of having to fulfill financial obligations, perform the tasks specified in this point after receiving notice from the tax authority on the completion of financial obligations.
In case of a request for dispute resolution, the parties shall be instructed to submit the request to the competent state agency to resolve the dispute according to regulations.
(2) How to do:
a) Submit directly at the Public Administration Service Center or the Land Registration Office or the Branch of the Land Registration Office.
b) Submit via postal service.
c) Submit online on the Public Service Portal.
d) Submit at the location agreed upon between the applicant and the Land Registration Office or Branch of the Land Registration Office.
(3) Components and number of documents:
- Profile components:
a) In case the original land plot has a Certificate, the additional area due to receiving the transfer of the right to use a part of the land plot has been granted a Certificate:
- Application for registration of changes in land and assets attached to land according to Form No. 18 issued with Decree No. 151/2025/ND-CP.
- Certificate issued.
- Documents on receiving transfer of land use rights for the increased area.
- Excerpt of cadastral map of land plot.
- Documents on representation according to the provisions of civil law in cases of carrying out procedures for land registration and property attached to land through a representative.
b) In case the original land plot has a Certificate, the increased area is the land area that has not been granted a Certificate:
- Application for registration of changes in land and assets attached to land according to Form No. 18 issued with Decree No. 151/2025/ND-CP.
- Certificate issued.
- Documents proving the additional area (if any).
- Excerpt of cadastral map of land plot.
- Documents on representation according to the provisions of civil law in cases of carrying out procedures for land registration and property attached to land through a representative.
- Number of documents: 01 set
(4) Time limit for settlement :
- No more than 10 working days for cases where the original land plot has a Certificate, the additional area due to receiving the transfer of the right to use a part of the land plot has been granted a Certificate.
For mountainous communes, islands, remote areas, areas with difficult socio -economic conditions, areas with especially difficult socio -economic conditions, the implementation time shall not exceed 20 working days.
- No more than 20 working days for the case where the original land plot has a Certificate, the increased area is the land area that has not been granted a Certificate
For mountainous communes, islands, remote areas, areas with difficult socio-economic conditions, areas with especially difficult socio-economic conditions, the implementation time shall not exceed 30 working days.

- Decree No. 101/2024/ND-CP dated July 29, 2024 of the Government regulating basic land survey, registration, granting of Certificates of land use rights, ownership of assets attached to land and Land information system.
- Decree No. 118/2025/ND-CP dated June 9, 2025 of the Government regulating the implementation of administrative procedures under the one-stop and inter-connected one-stop mechanism at the One-stop Department and the National Public Service Portal.

Instructions for filling out the form:

INSTRUCTIONS FOR WRITING SOME INFORMATION
AT THE INFORMATION TRANSFER FORM
Section I. (1) Record the administrative procedure file code according to the provisions of the Government's Decree regulating the implementation of administrative procedures under the one-stop and one-stop mechanism in handling administrative procedures. (2) Record the time of receiving complete and valid documents on the Document Receipt and appointment for returning results. Section II. Record information about land users and owners of assets attached to land. In case many people share the right to use land and the right to own assets attached to land, record information about one representative and a list according to Form No. 19a. (3) Individuals write their full name and year of birth; Households record the names and years of birth of household members sharing land use rights; husband and wife record the full names and years of birth of both husband and wife; communities record the name of the community. Organizations register their names according to the establishment decision or business registration certificate, investment license; foreign individuals and people of Vietnamese origin residing abroad register their full name, year of birth, and nationality. (4) Address to send Notice of financial obligations and, if necessary, contact to request provision of additional documents as prescribed. (5) Record the Decision on establishment or Business registration certificate.... for organizations; passport number for foreign individuals and people of Vietnamese origin residing abroad; identification number for domestic individuals. (6) Record the type of procedure such as: first issuance of Certificate, transfer, donation, etc. Section III. Point 3.1. Record land plot information. In case there are many land plots, make a list according to Form No. 19a. (7) Record the house number, street name (if any); name of residential area (neighborhood group, village, hamlet, village, hamlet, village, bon, buon, phum, soc, similar residential area) or name of area, field (for land plots outside residential areas); name of administrative unit at commune and province levels where the land plot is located. (8) Land use purpose according to land classification and is the purpose of calculating land use fees, land rent or purpose after changing land use purpose. (9) Record the form of land use as: Land allocation without land use fee collection/Land allocation with land use fee collection/Land lease with one-time payment for the entire lease term/Land lease with annual land rent payment; in case of changing the form of land use, record the form of land use before and after the change. (10) Record the name of the document type, number, date, month, year and summary of the document.
