Implement projects to preserve, restore and renovate relics and works, investment projects according to the provisions of Decree No. 208/2025/ND-CP of the Government

There is Official Dispatch No. 2394/ SVHTTDL-QLVHGĐ, dated October 24, 2025 requesting agencies and units; People's Committees of communes and wards ; organizations and individuals operating in the field of heritage restoration area in the province carry out preservation and restoration projects restoration of monuments and works, projects investment as prescribed in Decree No. 208/2025/ND-CP of the Government .

Accordingly, it is recommended that the People's Committees of communes and wards; organizations and individuals operating in the field of relic restoration in the province study the provisions of the Law on Cultural Heritage No. 45/2024/QH15 dated November 23, 2024 (effective from July 1, 2025), replacing the Law on Cultural Heritage 2001, the Law amending and supplementing a number of articles of the Law on Cultural Heritage 2009; Decree No. 208/2025/ND-CP dated July 17, 2025 (effective from September 1, 2025), replacing Decree No. 166/2018/ND-CP dated December 25, 2018 of the Government; Decree No. 215/2025/ND-CP dated August 4, 2025 (effective from September 17, 2025), this Decree replaces the Government's Decrees: Decree No. 86/2005/ND-CP dated July 8, 2005, Decree No. 109/2015/ND-CP dated October 28, 2015, Decree No. 109/2017/ND-CP dated September 21, 2017 and Decree No. 39/2024/ND-CP dated April 16, 2024 and other relevant legal provisions to carry out activities of managing and protecting relics, implementing projects to preserve, restore and renovate relics.

For the Project of preserving, restoring and renovating relics, the confirmation of degraded relics must be carried out to establish a relic restoration project according to the provisions of Article 22 of Decree No. 208/2025/ND-CP. The Feasibility Study Report on Preserving, Restoring and Renovating Relics, Feasibility Study Report on Preserving Relics, and Economic and Technical Report on Preserving, Restoring and Renovating Relics must be examined and appraised before being submitted for approval and ratification (Clause 5, Article 24), in which special attention must be paid to a number of new points compared to Decree No. 166/2018/ND-CP (replaced by Decree No. 208/2025/ND-CP) for implementation.

Specifically, regarding the appraisal authority: The Ministry of Culture, Sports and Tourism is responsible for appraising the Feasibility Study Report on the Preservation, Repair and Restoration of Monuments, Feasibility Study Report on the Preservation of Monuments, Economic and Technical Report on the Preservation, Repair and Restoration of Monuments for World Heritage Sites, Special National Monuments, and National Monuments; Provincial-level cultural agencies are responsible for appraising the Feasibility Study Report on the Preservation, Repair and Restoration of Monuments, Feasibility Study Report on the Preservation of Monuments, Economic and Technical Report on the Preservation, Repair and Restoration of Monuments for provincial-level monuments and monuments in the List of Monument Inventory (Clause 2, Article 23 of Decree No. 208/2025/ND-CP).

Regarding the legal basis and content of appraisal: appraisal shall be carried out in accordance with the provisions of the law on cultural heritage and the law on construction, according to the specific contents stipulated in Article 30 of Decree No. 208/2025/ND-CP. In case of necessity, the Ministry of Culture, Sports and Tourism, the provincial-level cultural professional agency shall request the investor of the relic restoration project to select an organization with sufficient capacity to appraise the Feasibility Study Report on the preservation, restoration and rehabilitation of relics, the Feasibility Study Report on the preservation of relics, the Economic - Technical Report on the preservation, restoration and rehabilitation of relics according to the requirements of the appraisal agency, organization, and the person deciding on the investment (Point d, Article 31 of Decree No. 208/2025/ND-CP).

Regarding the appraisal request dossier, it is necessary to include: Report on appraisal results according to the provisions of the law on construction (Point e, Clause 1, Article 29, Decree No. 208/2025/ND-CP). Supplementing instructions on implementing the Economic - Technical Report on urgent restoration of relics (Article 33, Decree No. 208/2025/ND-CP). Supplementing instructions on implementing the Design of construction drawings for preservation, repair and restoration of relics, Design of construction drawings for preservation of relics (Section 3, Chapter III).

For investment projects in construction, construction of works, use of sea areas to carry out exploitation and use of marine resources, carry out socio-economic activities inside and outside the protected areas of world relics and heritages: It is necessary to collect opinions according to the provisions of Articles 43, 44 and 45 of Decree No. 208/2025/ND-CP.

For the repair, renovation and construction of individual houses located inside and outside the protected areas of world heritage sites and monuments: It is necessary to collect opinions according to the provisions of Articles 46, 47 and 48 of Decree No. 208/2025/ND-CP.
