Current situation and solutions to prevent and combat human trafficking crimes

Currently, not only in many countries around the world, but also in Vietnam, the situation of human trafficking crimes is complicated. Human trafficking is classified by the United Nations as one of the four most dangerous crimes, directly infringing on life, health, honor and dignity - the most basic human rights.

Previously, the victims of human trafficking were mostly women and girls, but in recent years the number of male victims has increased. Through social networks, the subjects use messages, communication, data encryption and many sophisticated tricks, which are very difficult to detect, operate on a large scale and manage transnational criminal groups, making the problem of human trafficking complicated and serious. Vietnam is considered one of the countries with many human trafficking cases.

Specifically, in 2018 - 2022, Vietnam discovered 440 human trafficking cases, including 876 subjects and 1,240 victims. According to data from the An Giang Border Guard, if in the past, victims of human trafficking were mainly women and girls, in recent years, men in their teens, infants, fetuses, and organs have also become the subjects of trafficking. In particular, male victims have increased rapidly. Before 2021, men accounted for 16%, now it has increased to 64%. At that time, most of the victims were in remote, mountainous areas, ethnic minorities, now up to 81% are from the plains. If in the past, the majority of victims were taken to China, now this country only accounts for 12%, Laos 36%, Cambodia 32%, Myanmar 16%, and domestic accounts for about 4%.

With the lure of “easy work, high salary”, human trafficking criminals exploit the psychology of those who need work and money but are gullible to lure and organize the illegal crossing of the border to force victims to do illegal work. Or take advantage of simple marriage procedures with foreigners to adopt/adopt children with foreign elements, then sell them abroad for forced labor, forcing them to commit various types of fraud.

Typically, on August 18, 2022, at Casino Rich World area, Chrey Thom hamlet, Sampoeu Poun commune, Kaoh Thom district, Kandal province, Kingdom of Cambodia (opposite Long Binh town, An Phu district), 42 Vietnamese people ran from Casino Rich World, jumped into Binh Di river to illegally enter Vietnam through Tan Khanh hamlet, Long Binh town, An Phu district. 40 people were able to swim back, 1 person went missing while swimming, 1 person was caught by Casino Rich World staff, beaten and seriously injured.

The case was clarified and confirmed by the An Giang Provincial Police Investigation Agency: Through social networks, most of the victims listened to the subject's promise to do "easy work, high salary" so they illegally left the country. Upon arrival, some were "handed over" to Chinese people and then sold back and forth for profit; some were locked in the 13-story building of Casino Rich World, with strict bodyguards. Their assigned job was to defraud customers through social networks or gamble to steal other people's money. Every day, the victims worked from 10am to 11pm - 12pm. If the sales revenue was 300 million VND/month or more, they would be paid, below this amount, it was considered a waste of time and most people could not achieve it. Some people escaped, and when caught, they were brutally beaten. Knowing they had been scammed, waiting for the security team to let them slip, the group decided to escape together.

Taking advantage of marriage with foreigners, or through job brokers, the subject takes advantage of the trust of gullible women and organizes to bring the victims to Cambodia illegally. After that, the subject finds someone to sell the victims for illegal profits. Typically, the sale of children to foreigners was sentenced by the People's Court of An Giang province to Huynh Thi Luom, Nguyen Thi Cam Tu (who used to live in Fujian province, China) each to 8 years in prison and Nguyen Ngoc Lan (My Thanh ward, Long Xuyen city), Pham Thi Thu Ha (Xuan Khanh ward, Ninh Kieu district, Can Tho city) each to 7 years in prison for the crime of "Buying and selling children" is a warning.

Most law violators and many victims are greedy, ignorant of the law, and do not foresee the consequences of their actions. The 2015 Penal Code (amended and supplemented in 2017) stipulates the crime of “Human trafficking” and the crime of “Trafficking in persons under 16 years of age” in Articles 150 and 151, punishing those who commit human trafficking with imprisonment from 8 to 15 years or from 12 to 20 years.

Human trafficking is not only a violation of the law, but also one of the pressing problems of modern society, causing many serious consequences for victims and the community. To prevent and combat human trafficking, in the coming time, all levels, sectors and local authorities will further strengthen propaganda andeducation on the prevention and combat of human trafficking. Educate citizens to be aware of the tricks of human trafficking criminals to raise their sense of vigilance, promptly detect and denounce the activities of criminals to law enforcement agencies.

At the same time, improve the capacity and effectiveness of investigation, prosecution and trial of human trafficking crimes; perfect legal regulations on the fight against this dangerous crime with strict sanctions to punish human trafficking acts. In particular, effectively implement international conventions and documents related to the prevention and combat of human trafficking that Vietnam has joined and actively and effectively operate.

As a solid shield, each family and individual must heighten their vigilance to protect themselves and their loved ones, and absolutely not trust information on social networks without verification to avoid being lured and deceived. When an incident occurs, the victim or the victim's family should immediately contact the nearest police agency to promptly take measures to handle the incident.
