Discussing a number of draft laws, including amendments to the Law on Bidding, on the afternoon of May 17, General Secretary To Lam emphasized that Resolution 66 was issued with the goal of building a synchronous, feasible, and transparent legal system, thoroughly eliminating barriers caused by overlapping and contradictory laws.

According to the General Secretary , comprehensively amending the law is very difficult and complicated because "one law is entangled with another law." In the context of "running and queuing at the same time", it is impossible to amend all the laws. If we wait to amend the law, development will be delayed.

"The law does not serve the interests of any group. There must be clear decentralization and delegation of power, linked to responsibility, the mechanism of asking and giving must be eliminated, local interests and special privileges and groups must be eliminated," the General Secretary said, noting that the mindset of "whoever drafts a bill must protect their own interests and create benefits for themselves in that matter" must be abandoned.

Giving specific opinions on amending 1 law and 7 laws in the investment field, the General Secretary also noted that this is a very difficult task, but it is a weak point that needs to be resolved. "For many years, there has been money but it has not been spent, while the country's development needs are very large, we have to borrow from abroad. Why? Because the bidding process has ended this year. Several months of selecting bids, opening bids, several months of evaluating bids. There is no time left to implement, while the budget money must be within the year," the General Secretary stated, adding that public investment in the first quarter was almost not spent at all because of legal problems.


In particular, the General Secretary said that if we want to amend the Bidding Law, we need to summarize what "crimes" are in bidding? "Very serious crimes, such as slow development progress, poor quality, and the crime of losing cadres and not being economical. The goal of bidding is to be effective, speed up progress and have good projects, but it cannot be done. So how can we cure this disease?", the General Secretary stated.

Citing evidence from bidding in the health sector, according to the General Secretary, with the way of bidding for drugs like auctions, "Vietnamese patients cannot access the world's advanced drugs". Patients have to carry them by hand, outside the law, creating conditions for smuggling and counterfeiting. Meanwhile, the hospital provides medicine but no one takes it, which is very wasteful.

"Do patients have access to the most advanced machinery and modern technology? Whose fault is this, the fault of the regulations and the fault of the implementation. We must cure these things," the General Secretary requested.

In addition, the provisions in the law also make public investment, public-public partnership or public-private partnership difficult. For example, public-public partnership, the state budget lacks money, but even if localities want to contribute, they cannot because of regulations.


"BOT is dead, BT is dead. Every country has policies and guidelines, but we can't do them in our country, so we abandon them and ban them. Later, we see that they are good and restore them. Those things are very frustrating, projects can't be accelerated, bidding can't select good people," the General Secretary said, pointing out the fact that there are good construction companies "they don't need to bid and still have plenty of work."

"Our private enterprises are very cold and unfair, but with foreign investment, it's okay. State-owned private enterprises are even more dedicated, but if you participate in the project, you will definitely say "this, that", thinking that way yourself so you can't develop it," said the General Secretary.

Notably, the problem is that "private enterprises buy technology, even buy factories abroad but are not allowed to do it in Vietnam". According to the General Secretary, these are very painful things, the law must be amended to solve them, to open up huge resources in the private sector. How to quickly disburse public investment capital, how to achieve public-private cooperation.

The General Secretary also stated: "Bidding is said to prevent negativity, but in reality, can it be prevented or is it collusive bidding, selling out bids, covering up for each other? They say that road construction has this machine or that machine, but in reality, bidding up to F9, F10, workers are still sitting carrying rocks, breaking rocks, and there is no sign of any machinery. In cases like that, why don't we condemn and denounce them? We have to swallow our pride even though it's our money. For example, when building a house, I don't bid, I find the best architect and builder to do it for me. State projects also have to be responsible like our own houses," the General Secretary emphasized.
