The People's Committee has just issued a procedure for paying land funds for BT projects that have been stalled for many years to quickly resume construction and put the projects into operation to avoid waste.
Ho Chi Minh City People's Committee has just issued Document No. 8119/UBND-DT on the land fund payment process for BT (build-transfer) projects according to the mechanism and policies of Resolution 98/2023/QH15.
The first condition when paying by land fund is that the land determined for payment in the BT Contract must be land managed by the State and subject to the case of rearrangement and handling of public assets as determined in the BT Contract.
Next, the land determined for payment in the BT Contract must have its detailed planning 1/500 approved by a competent State agency as a basis for determining financial obligations.

The time for land allocation and land lease for payment is based on the completed construction volume of the BT project, which has been accepted by a competent State agency in accordance with the provisions of law and audited.
At the time of carrying out land allocation and land lease procedures, the investor's financial obligations must be calculated. At the same time, the price for calculating land use fees and land rents must be determined at the time of deciding on land allocation and land lease.
Regarding the procedure for paying BT land fund to investors, there are 4 steps.
Step 1: Prepare, appraise and approve the detailed planning at a scale of 1/500 or the master plan of the land for payment. The time to carry out this step is 20 days for appraisal and 15 days for approval of the planning. The implementing agency is the district-level People's Committee and relevant functional agencies.
Step 2: Land allocation and lease are carried out by the Department of Natural Resources and Environment of Ho Chi Minh City within 30 days.
Step 3: The Department of Natural Resources and Environment of Ho Chi Minh City determines the land price . The implementation period is 180 days from the date of issuance of the decision on land allocation and land lease according to the provisions of Clause 4, Article 155 of the 2024 Land Law (the specific land price determination period is not included in the time for carrying out procedures for land allocation, land lease, and issuance of certificates of land use rights and ownership of assets attached to land).
Step 4: The Department of Natural Resources and Environment of Ho Chi Minh City shall issue the certificate of land use rights and ownership of assets attached to the land within 3 days from the date the investor is confirmed by the tax authority to have completed its financial obligations.
The issuance of land fund payment procedures for BT projects is the basis for project investors and departments and branches in Ho Chi Minh City to implement.
This is a very important step to remove the land payment procedures for BT projects that have been stalled for many years such as: 2.7 km Ring Road 2 Project, 10,000 billion VND Flood Prevention Project to resume construction soon to complete and put into operation to avoid waste.
