Ho Chi Minh City strictly handles violations in the use of public houses and land

Cases of improper use of public assets such as leasing, joint ventures, associations, and loans will be strictly handled. The violating area may be confiscated, or forced to stop using the violation if it cannot be separated.

The People's Committee of Ho Chi Minh City has just issued a Plan to implement Decree No. 03/2025 dated January 1, 2025 of the Government , regulating the rearrangement and handling of public assets such as houses and land.

Accordingly, all agencies, organizations and units directly managing and using public land and houses in Ho Chi Minh City must complete the declaration report and propose a plan for arrangement and handling before June 1, 2025.

The plan must clearly state the appropriate form of handling such as retention, transfer, recovery, transfer to local management, etc., along with full legal documents, current status of use and related papers. The synthesizing agencies at the department, industry and local levels will review, coordinate to inspect the current status, prepare a summary report and send it to the Department of Finance for submission to the Ho Chi Minh City People's Committee for consideration and approval.

Ho Chi Minh City also pays special attention to handling violations. Cases of using public assets for the wrong purposes such as leasing, joint ventures, associations, and loans in violation of regulations will be strictly handled. The violating area may be confiscated, or forced to stop using the violation if it cannot be separated. Illegal revenues must be returned to the city budget.

For houses and land used for illegal housing that do not meet the conditions for transfer to the locality, the management agency is responsible for relocating residents out of the premises; at the same time, coordinate with the compensation and site clearance unit to develop a compensation, support, and resettlement plan and determine the responsibility of the organization or individual that transferred the land without authority.

For state-owned enterprises in the city, the deadline for submitting a report on the list of assets subject to transition is before May 30, 2025. Units that do not declare and propose plans on time will be held accountable, including related organizations and individuals.
