At noon on April 5, a student was driving a motorbike over 50cc on Nguyen Xi Street (Binh Thanh District), talking on the phone while driving.

The Ho Chi Minh Cityeducation sector, together with the police force and other authorities, have made great efforts in disseminating traffic safety laws to students and parents in recent times. On April 3, a high school in District 5 sent a notice to all parents requesting that all students strictly comply with traffic safety laws and are not allowed to drive motorbikes over 50 cm3 (or 50 cc).

"Students are strictly prohibited from riding motorbikes that do not comply with regulations, only use the correct engine size allowed for their age. The school absolutely does not keep motorbikes for students in case they do not comply with regulations. There will be strict handling of cases where students are found to be riding motorbikes that do not comply with regulations (including keeping motorbikes in residential areas near the school). The school will seriously implement the instructions of the Department of Education and Training and Ho Chi Minh City. We respectfully ask parents to strictly remind students to comply with regulations and traffic laws, to avoid unfortunate incidents that affect their future," according to the announcement.

Also on April 3, the Department of Education and Training of District 7, Ho Chi Minh City also issued a document implementing plan No. 1811/KH-BATGT-CAQ dated April 1, 2024, implementing Directive 31/CT-TTg dated December 21, 2023 of the Prime Minister on strengthening the work of ensuring traffic safety and order for school-age children in the new situation.

The Department of Education and Training of District 7 requested that kindergartens, primary schools, and secondary schools (both public and non-public) proactively coordinate with the District Police to propagate and educate about traffic safety laws; have students sign a commitment not to violate traffic safety laws; propagate parents not to give vehicles to children who are not qualified to participate in traffic...

The document also clearly states that when discovering or receiving notice of students driving motorbikes or mopeds in violation of regulations or violating traffic laws, the school must be responsible for inviting the student's parents to work; clearly announcing the violation and requesting coordination in managing and educating the student to commit not to repeat the offense.

How do students comply?

At the gate of Nguyen Khuyen High School's parking lot (Thanh Thai Street, District 10, Ho Chi Minh City), Thanh Nien reporters saw a paper notice with the following content: "Starting from April 5, 2024, the parking lot will not accept motorbikes of students who do not ride according to regulations and do not have a driver's license."

When we asked "If I accidentally ride my parents' motorbike, where can I park it?", a student pointed to the District 10 Sports Center opposite the school gate.

At 11:30 a.m. on April 5, from the parking lot gate of the District 10 Sports Center, we recorded many students wearing uniforms from Dien Hong Secondary and High School (also located on Thanh Thai Street, District 10) parking their motorbikes over 50 cm3 here and taking them home.

Also at noon on April 5, according to Thanh Nien reporters on Nguyen Xi Street (Binh Thanh District), many students from Thanh Da High School violated traffic laws after school hours by driving motorbikes over 50 cm3 . In addition, many students riding electric vehicles and motorbikes did not wear helmets, were riding in threes, and were going in the wrong direction...

Lawyer Le Trung Phat, Director of Le Trung Phat Law Firm, Ho Chi Minh City Bar Association, said that according to Article 60 of the 2008 Road Traffic Law, people aged 16 and over are allowed to drive motorbikes with a cylinder capacity of less than 50 cm3 ; people aged 18 and over are allowed to drive two-wheeled motorbikes with a cylinder capacity of 50 cm3 or more.

According to Article 58, drivers participating in traffic must have a driver's license appropriate to the type of vehicle they are allowed to drive. Thus, students of any level of education who are under 18 years old are not allowed to drive motorbikes with a cylinder capacity of over 50 cm3 . Notably, according to lawyer Phat, if parents/vehicle owners hand over the vehicle to someone who is not qualified to drive, this act will be subject to administrative penalties.

From September 1, 2023 to now, 652 students have been fined for violating road traffic laws.

A representative of the Traffic Police Department (PC08, Ho Chi Minh City Police) said that since the beginning of the school year, teams/stations under the department have held many sessions to propagate Road Traffic Laws at schools.

Traffic police patrol teams also proactively patrol, control, and handle violations of underage students driving motorbikes before and after school hours. When checking and handling violations, traffic police record full information about the violators such as: full name, year of birth, school name... to coordinate with the school to manage and educate the students.

From September 1, 2023 to present, Ho Chi Minh City Traffic Police have recorded 652 cases of students violating the Road Traffic Law. In which, the main violation for students is driving a motorbike when underage.

At the same time, the traffic police issued a fine to the parents of these students for handing over their vehicles or allowing them to be given to people who are not qualified according to regulations. The traffic police of Ho Chi Minh City advise parents to absolutely not hand over their vehicles to students who are not old enough or not qualified to drive a motorbike. Students also need to be proactive, set an example in obeying the law, and wear helmets when participating in traffic.

According to Decree 100 of 2019 of the Government, individuals - who are owners of motorbikes and mopeds - will be fined from 800,000 - 2,000,000 if they hand over their vehicles or allow unqualified people to drive them on the road.
