According to Article 2 of Decree 178/2024/ND-CP (amended by Clause 2, Article 1 of Decree 67/2025/ND-CP), commune-level civil servants are one of the subjects of application of the decree.
Meanwhile, Article 24 of Decree 178/2024/ND-CP (supplemented by Clause 18, Article 1 of Decree 67/2025/ND-CP) stipulates:
Effective Date
1. This Decree comes into force from January 1, 2025.
2. Those who have enjoyed the policies prescribed in Decree No. 29/2023/ND-CP dated June 3, 2023 of the Government on streamlining payroll before January 1, 2025 will not enjoy the policies and regimes prescribed in this Decree.
3. The provisions on receiving a subsidy of 5 months of current salary for the first 20 years of work and 0.5 months of current salary for each year of work from the 21st year onwards at Point a, Point b and Point c, Clause 2, Article 7 of this Decree shall be effective until before the effective date of the Law on Social Insurance 2024.
The regulation on receiving a subsidy of 4 months of current salary for the first 15 years of work and 0.5 months of current salary for each year of work from the 16th year onwards at Point a, Point b and Point c, Clause 2, Article 7 of this Decree applies to female commune-level cadres and civil servants, effective from January 1, 2025.
Thus, if commune-level civil servants have enjoyed the policies prescribed in Decree 29/2023/ND-CP dated June 3, 2023 of the Government on streamlining payroll before January 1, 2025, they will not enjoy the policies and regimes for early retirement in Decree 178/2024/ND-CP.
