The citizen who was received was Mr. Tran Ngoc An, from Nam Dong commune, Cu Jut district. Mr. An is the person who has made many petitions about the Cu Jut district People's Committee's illegal land reclamation, seriously affecting the legitimate rights and interests of his family.

According to the case file, in 1993, Mr. Tran Ngoc An was assigned by the Nam Dong Commune People's Committee the right to manage and use a 70m2 kiosk (20m long, 3.5m wide), located on the Nam Dong - Ea Po inter-commune road. The purpose of using the land plot was for housing and business purposes.
In 2006, Mr. An applied for a land use right certificate (red book) for the above 70m2 plot of land. However, the People's Committee of Nam Dong commune only agreed to grant him a red book for an area of 35m2 . Disagreeing with the above result, Mr. An submitted an application to the People's Committee of Cu Jut district and then to the People's Committee of Dak Nong province.

In October 2007, the Dak Nong Provincial People's Committee issued a decision to resolve Mr. An's complaint. In the decision, the Provincial People's Committee recognized Mr. An's right to complain about his land use rights of 70 square meters .
Dak Nong Provincial People's Committee determined that Mr. An is eligible to be granted a red book for an area of 35m2 (10m long, 3.5m wide). The remaining area of 35m2 belongs to the road corridor and the local government is responsible for calculating and compensating.

But then, the People's Committee of Cu Jut district only issued a red book for an area of 35 square meters to Mr. An. For the remaining area of 35 square meters , Cu Jut district proposed that the Provincial People's Committee not compensate but proposed to let Mr. An's family continue to use it. When there is a need to expand the road, the district will make a compensation plan. This proposal was approved by the People's Committee of Dak Nong province.
Mr. An then continued to complain to the local authorities. In June 2009, the People's Committee of Cu Jut district decided to give Mr. An a resettlement plot of land measuring 244 square meters in Nam Dong commune.

Mr. An said that Cu Jut district granted land to his family with the purpose of making him stop complaining. However, the representative of Cu Jut district People's Committee said that the resettlement land was granted to Mr. An because the family had submitted a request and promised to voluntarily hand over the land after being allocated land.
According to the Department of Agriculture and Environment, the 35m2 area has not been compensated for Mr. An's family due to financial constraints. This was proposed by the People's Committee of Cu Jut district and accepted by the Provincial People's Committee.

The decision of the People's Committee of Cu Jut district to grant resettlement land to Mr. An's family was based on the family's petition, expressing the family's wishes. However, the fact that the People's Committee of Cu Jut district did not prepare a dossier, the process of land recovery and resettlement is not in accordance with the law.
The representative of Dak Nong Province Inspectorate also said that the process of granting a 244m2 resettlement plot to Mr. Tran Ngoc An's family was not strict. Because Mr. An's land was not revoked and he was not eligible for resettlement land.

At the meeting, Standing Vice Chairman of the Provincial People's Committee Le Trong Yen and leaders of departments, branches and localities frankly acknowledged the incident and analyzed it in accordance with the provisions of the law. Comrade Le Trong Yen explained and acknowledged the opinions, thoughts and wishes of Mr. Tran Ngoc An.
Comrade Le Trong Yen assigned the People's Committee of Cu Jut district to properly implement the contents of the decision to resolve complaints from the Provincial People's Committee in 2007. Before June 15, the People's Committee of the district must invite Mr. An to work, explain the contents in accordance with regulations or apologize to the people if the government has not done correctly.

If after the meeting between the District People's Committee and Mr. An, a common voice is still not found, the Dak Nong Provincial People's Committee will direct the Department of Agriculture and Environment to coordinate with the Provincial Inspectorate to intervene. The authorities will clarify the entire origin of the land, the land recovery process, the resettlement land allocation... and the responsibilities of the individuals and groups involved.
Standing Vice Chairman of Dak Nong Provincial People's Committee Le Trong Yen emphasized: Mr. An's case has lasted for nearly 20 years, mainly because the local government and the people have not found a common voice. We should sit down together again to discuss with each other before making a recommendation to the Provincial People's Committee for direction. The ultimate goal is that the case is resolved in a reasonable and lawful manner and the situation is not allowed to become complicated and prolonged.
