Regulation No. 205-QD/TW dated September 23, 2019 of the Politburo on controlling power in personnel work and combating the abuse of power and positions after 3 years of implementation, has initially contributed to creating positive changes, raising awareness and responsibility of all levels, sectors, cadres and party members. The situation of abuse of power, abuse of power, manipulation in personnel work; using assigned power to serve personal interests or covering up, abetting corruption and negativity in personnel work has been gradually overcome.
However, the identification, detection and handling of violations of the acts of seeking positions and power, and covering up and assisting in seeking positions and power, are still limited and have not achieved the desired results. Notably, some local, agency and unit leaders have not been exemplary, appointing and introducing relatives and people with family relationships to lead and manage the agencies and units they are in charge of, causing public outrage.

Therefore, Regulation No. 114-QD/TW on controlling power and preventing and combating corruption and negativity in personnel work was issued on the basis of inheriting the relevant contents of the previous Regulation 205 and supplementing and amending some contents to suit the requirements and practical situation, in order to further strengthen the control of power and prevent and combat corruption and negativity in personnel work.
The first noticeable new point is in the name of Regulation 114: "controlling power and preventing corruption and negativity in personnel work" instead of the previous Regulation 205 which only "controlled power in personnel work and prevented the abuse of power and positions".
Further clarifying this new point, Associate Professor Dr. Pham Van Linh, Vice Chairman of the Central Theoretical Council, said that if we only fight against the abuse of power and position in personnel work, we will not eliminate all negative aspects, but there will be many other negative aspects. Therefore, we must "control power and prevent corruption and negative aspects in personnel work", which will be more complete and broader, more comprehensive, and more thorough in all aspects.
Notably, regarding corruption and negative acts in personnel work, Regulation 114 not only inherits some contents of Regulation 205 but also adds many new contents.
Regarding the group of acts of taking advantage of and abusing positions and powers, in addition to the 8 acts of covering up and assisting in the promotion and promotion of positions and powers in Regulation 205, Regulation 114 has pointed out new acts: "Incorporating personal intentions when carrying out stages in personnel work for the motive and purpose of personal gain or benefiting personnel in the process of carrying out personnel work"; "Directing and advising on stages in personnel work according to the provisions of Clause 1, Article 2 of this Regulation for personnel who do not meet the conditions and standards; not in accordance with principles, regulations, procedures, rules, and decisions"; "When receiving petitions, letters of reflection, denunciation or knowing that personnel have corrupt or negative acts in personnel work but compromising, condoning, covering up, not handling according to authority, handling not in accordance with regulations or not reporting to competent authorities for handling".
Regarding the group of acts of running for positions and power, Regulation 114 also basically inherits the 6 acts that have been pointed out in Regulation 205, and at the same time adds a new act: "Running for age, seniority, emulation titles, rewards, degrees, assignments, appointments, nominations, nominations, designations, transfers, rotations, secondments, conferring, and promoting military ranks... for the purpose of meeting the standards, conditions, and obtaining positions and benefits".
Regulation 114 also adds a number of new negative behaviors: “Lack of responsibility or personal motives causing loss or damage to personnel records under management authority”; “Forging or falsifying records and documents for consideration and implementation of regulations, processes, rules and decisions on personnel work”; “Reporting, preparing records and declaring party member and cadre records, especially personal and family history, incompletely and dishonestly”; “Directly or through others, taking advantage of mass media and social networks to provide false information, distort, incite, cause internal disunity, and negatively affect personnel work”.
Compared to Regulation 205, Regulation 114 clearly states the act of directly or indirectly brokering and receiving bribes to help others obtain positions, titles, and benefits. It can be seen that the Party's regulations have never had new points like this regulation.

Associate Professor Dr. Pham Van Linh said that although it has just been included in this regulation, many corrupt and negative acts, even very serious ones, have existed before. In the past, we have also disciplined many officials who have violated the law. The Central Committee's inclusion of the regulation shows its determination, as the General Secretary said, to control power, to lock power in a cage of mechanisms, so that those who want to be corrupt cannot be corrupt, and those who want to take advantage cannot be taken advantage of.
While in Regulation 205, the regulations on the responsibilities of organizations and individuals in combating the practice of seeking positions, power, covering up, and assisting in the practice of seeking positions and power are contained in the content of 1 article, in Regulation 114, this content is expanded, specifically in 5 articles (Articles 6, 7, 8, 9, 10, 11), including: responsibilities of Party committees, Party organizations, and local leadership collectives, agencies, and units; responsibilities of members of Party committees, Party organizations, and leadership collectives; responsibilities of heads of Party committees, Party organizations, and leadership collectives; responsibilities of heads of advisory agencies; responsibilities of advisory staff and responsibilities of personnel.
Regarding the disciplinary action against erring officials in the past, many opinions said that individuals and agencies that introduced and proposed officials have not been held responsible. Now, in Regulation 114, there is a very clear provision on the responsibility of the head of the advisory agency (Article 9) and the responsibility of the advisory officer (Article 10).
Specifically, the head of the staff agency must "be responsible to the Party Committee, Party organization, and collective leadership for proposing, commenting, evaluating, and assessing personnel, personnel records, and supervising personnel processes; regularly inspecting and supervising cadres in his/her agency or unit; promptly detecting, recommending, and strictly handling violations in personnel work....
Staff officers must ensure objectivity, impartiality, honesty, accuracy, caution, and rigor in advising and proposing on personnel work. Be responsible for your proposals and evaluate personnel records promptly, completely, and accurately...
By including the regulation requiring the handling of individuals, the agency introducing and proposing cadres must take responsibility, the Vice Chairman of the Central Theoretical Council said that this once again affirms the Party's determination to attach responsibility and handle responsibility to the collective and individual who commit violations in cadre work, contributing to deterrence, warning, gradually cleaning up the apparatus, improving the effectiveness and efficiency of operations, consolidating the organization and cadres from the Central to local levels, especially to prepare for the personnel work of the 14th Party Congress.
