At the meeting, the Government listened to a summary report of the policy dossier; a report on receiving appraisal opinions and discussed actively to build: the Law on Personal Income Tax (replacement); the Law on E-commerce; the Law on Deposit Insurance (amended); the Law on Civil Aviation (amended); the Draft Law on Civil Judgment Enforcement (amended); the Draft Law on amending and supplementing a number of articles of the Lawon Education ; the Law on Higher Education (amended); the Law on Vocational Education (amended).
In particular, regarding the draft Law on Personal Income Tax (replacement), Government members discussed in depth the provisions related to the tax base, method of determining the amount of tax payable, personal income tax rates for income from salaries, wages, etc., including considering reasonable tax rates or tax exemptions and reductions for some incomes in special fields, encouraged by the State, etc.
Contributing opinions to the draft Law on E-commerce, Government members discussed clearly defining the subjects of e-commerce; classifying groups of subjects and responsibilities of subjects participating in e-commerce; promoting decentralization, delegation of authority, and simplification of administrative procedures; giving incentives to the private economic sector, small and medium enterprises, and individual business households; encouraging innovation, sustainable development, and a number of other priorities; linking with control of goods quality, anti-counterfeiting and counterfeiting; mechanisms for monitoring e-commerce activities, etc.
Delegates said that the development of the Law on Deposit Insurance (amended) is an urgent requirement to perfect the legal basis, improve the efficiency of deposit insurance activities, better protect the rights of depositors and stabilize the system of credit institutions. Members discussed the policies of the Law such as: deposit insurance premiums; improving the efficiency and financial capacity of the Deposit Insurance organization...
Regarding the Law on Civil Aviation (amended), the Government discussed and commented on the contents on safety, security, investment, exploitation of airports, airfields and air transport to institutionalize the policies of the Party and State, in accordance with international treaties... both meeting the requirements of socio-economic development and ensuring security and national defense; developing modern and sustainable aviation.
In the draft Law on Civil Judgment Enforcement (amended), the Government carefully considered groups of contents on the scope of civil judgments; rights and obligations of litigants; organization and operation of the civil judgment enforcement agency system; operation of bailiff offices; roles and responsibilities of relevant agencies, organizations and individuals in civil judgment enforcement; conditions to ensure and meet requirements for management and operation of civil judgment enforcement; tools and measures to ensure civil judgment enforcement...
In the draft laws related to education and training, including: Draft Law on amending and supplementing a number of articles of the Law on Education; Law on Higher Education (amended); Law on Vocational Education (amended), delegates are interested in the contents that are amended, supplemented, and abolished so that the provisions of the laws are consistent with the arrangement of administrative units, 2-level local governments, and the strategy for developing education and training in the new period.
In particular, along with analyzing the consistency between related laws, the reduction of administrative procedures along with decentralization and delegation of power, Government members are interested in the contents related to the management and operation of public and private educational institutions, higher education, vocational education, general education, preschool education, etc., especially regulations related to education and training in specific and special fields.
Giving specific comments on each of the above contents, Prime Minister Pham Minh Chinh pointed out that the development of the Personal Income Tax Law (replacement) must meet the requirements of correct, full and timely collection, but at the same time must encourage, create development and facilitate tax payment and refund.
Regarding the policy documents of the Law on E-commerce, the Prime Minister also emphasized the requirement for management to simultaneously promote development; manage in the direction of digitalization, ensuring efficiency; prevent smuggling, counterfeit goods, fake goods, poor quality goods, etc.
Regarding the policy documents of the Law on Civil Aviation (amended), the Prime Minister said that it is necessary to pay attention to clear management, without overlap; promote decentralization and delegation of power; mobilize resources from people and businesses to develop infrastructure.
Regarding the draft Law amending and supplementing a number of articles of the Law on Education; policy documents on the Law on Higher Education (amended); policy documents on the Law on Vocational Education (amended), the Prime Minister noted that the scale of schools and classes must be increased, branch campuses must be increased; post-inspection must be strengthened; quality must be improved, creating conditions for lifelong learning; professional management must be unified from the central to local levels, but human resource management must be assigned to localities.
Regarding vocational training, the Prime Minister noted that there should be mechanisms and policies to encourage people and businesses to do better, and that the State must do what people and businesses cannot do.
In particular, with the School Council regulations, the Prime Minister suggested that it is necessary to clearly analyze and carefully evaluate the impact, especially for public schools, while private schools can decide for themselves.
Concluding the meeting, Prime Minister Pham Minh Chinh highly appreciated the efforts and active preparation of ministries and ministerial-level agencies for submitting draft laws and policy documents for law-making, as well as the dedicated, responsible, practical and quality opinions of Government members on the two draft laws and six policy documents for law-making; requested the Ministers and heads of sectors to focus on directing and promptly completing the dossiers of the draft laws in accordance with regulations for submission to the National Assembly.
The Prime Minister said that since the beginning of 2025, the Government has reviewed and commented on more than 50 draft laws and resolutions. At the 9th Session alone, the Government submitted 43 laws and resolutions to the National Assembly, including many particularly important contents that meet practical requirements and create new development momentum.
Emphasizing the need to innovate the work of law making and enforcement to meet the requirements of national development in the new era according to Resolution No. 66-NQ/TW and resolutions of the National Assembly, the Government, the Prime Minister directed the Ministers and Heads of ministerial-level agencies to continue to prioritize time, focus the highest resources, directly lead and direct the completion of draft laws considered and commented at this Session to submit to the National Assembly and the National Assembly Standing Committee on time as required and ensure the best quality of each draft law.
The Prime Minister noted that the building and perfecting of legal institutions must ensure 6 enhancements: strengthening the leadership and concretization of the Party's policies and guidelines in the work of building and perfecting institutions and laws; strengthening the collection of opinions and absorbing opinions of relevant entities and affected subjects; strengthening mechanisms and policies to create development and serve the people; strengthening the reduction of administrative procedures to reduce costs for people and businesses, decentralization and delegation of power along with resource allocation; strengthening coordination with the National Assembly, National Assembly agencies, National Assembly deputies, agencies in the political system and experts and scientists; strengthening close adherence to practice, starting from practice, respecting practice, taking practice as a measure in building and perfecting legal institutions.
Specifying the division of labor must be clear in 6 aspects: "clear people, clear work, clear time, clear products, clear responsibilities, clear authority" in law-making, Prime Minister Pham Minh Chinh requires that the amended and supplemented laws must answer 5 whys: why are they omitted, why are they perfected, why are they supplemented, why are administrative procedures cut, and why are they decentralized and delegated; new laws must meet the 4 must requirements: must thoroughly grasp and concretize the Party's policies and guidelines; must solve practical problems; must satisfy the people's wishes; must meet the conditions for promulgation and implementation.
Noting that in the coming time, the task of building institutions and developing regulations to guide the Laws newly passed by the National Assembly is very heavy, Prime Minister Pham Minh Chinh requested Deputy Prime Ministers in charge of fields and Ministers and Heads of sectors to strengthen coordination and explain to the National Assembly about the laws and resolutions that the Government submitted to the National Assembly for approval at the 9th Session; at the same time, proactively develop and promulgate according to their authority or submit to the Prime Minister for promulgation plans for implementation; promptly disseminate, thoroughly understand and train laws and resolutions in appropriate forms according to the provisions of law.
