According to the document, for domestically purchased raw materials without value-added invoices, traders can use the declaration of exported goods meeting the "WO" (Wholly Obtained - purely obtained) criteria according to the form prescribed in Appendix II issued with Circular No. 44/2023/TT-BCT. This declaration is self-declared by traders and does not require confirmation from local authorities.
The Ministry of Industry and Trade said that according to Article 15 of Decree No. 31/2018/ND-CP, the application for C/O is not required to have a local confirmation. However, if necessary, the C/O issuing authority may conduct a physical inspection at the production facility or request the enterprise to provide additional documents such as invoices, customs declarations, sales contracts or confirmation minutes of industry associations, cooperatives, cooperative groups, etc. to prove the origin of raw materials.
Previously, on June 24, 2025, the Vietnam Pepper and Spice Association (VPSA) issued Official Dispatch No. 63/CV-VPSA to the Government Office , the Ministry of Industry and Trade and relevant agencies, proposing to remove obstacles in confirming the list of raw material purchases without invoices for the issuance of C/O.
According to VPSA, many pepper exporting enterprises are facing difficulties when local authorities in some localities refuse to confirm the list for reasons such as: doubting the authenticity of the raw material source; concerns about the possibility of counterfeiting; difficulties due to administrative changes; or lack of verification information from the people.
The association believes that these reasons are not really suitable for the characteristics of the agricultural sector, where purchasing activities mainly take place between businesses and small-scale farmers - those who do not issue invoices. This causes great obstacles to the process of applying for C/O, affecting the export capacity of the entire sector.
VPSA has recommended that the Ministry of Industry and Trade issue unified guidelines that are consistent with production practices, and at the same time propose to consider abolishing regulations on lists for some key agricultural products such as pepper, coffee, coconut, etc. In the short term, the Association also proposed allowing the application of flexible solutions, such as field verification, or using confirmation minutes from industry organizations, cooperatives, and cooperative groups in cases where the locality does not support confirmation.
According to experts, the new guidance from the Ministry of Industry and Trade is considered timely and suitable for the production and business practices of agricultural enterprises, especially in the context that many farming households do not issue invoices and raw material purchasing activities through traditional channels still account for a large proportion in key production areas.
The Ministry of Industry and Trade's issuance of specific and clear guidelines has promptly removed practical bottlenecks, creating a more transparent and open legal corridor for businesses in completing origin dossiers. The flexible mechanism, which does not require local confirmation, and allows the use of alternative confirmations in special cases, is expected to reduce administrative procedures and promote the export of key agricultural products.
