Add more groups of subjects in the safe zone to have health insurance paid for by the state budget

On the afternoon of October 24, discussing in groups about the draft Law amending and supplementing a number of articles of the Law on Health Insurance and the Law on Data, Deputy Head of the Delegation in charge of the National Assembly Delegation of Hoa Binh Province Dang Bich Ngoc suggested that the draft Law should add regulations that people living in communes of safe revolutionary zones and communes of key national defense areas should be included in the group of subjects covered by the state budget for health insurance. Along with that, it is necessary to specifically assess the ability to respond and balance the health insurance fund.

Research appropriate health insurance premiums

The Law on Health Insurance has been implemented for 15 years and has really come into effect with 93.628 million people participating in health insurance, reaching a coverage rate of about 93.35% of the population, an increase of 0.15% compared to the target of Resolution No. 68, 2022 of the National Assembly . This has affirmed the correctness and appropriateness of one of the country's social security policies. However, in the process of organization and implementation, there are still some shortcomings and difficulties. Therefore, amending the Law is necessary to promptly synchronize with the Law on Medical Examination and Treatment; the Law on Social Insurance recently passed by the National Assembly.

Regarding the subjects participating in health insurance in Clause 4, Article 12 of the draft Law, Deputy Head of the Delegation in charge of the National Assembly Delegation of Hoa Binh Province Dang Bich Ngoc agreed with the fact that the draft Law has added the subject "ethnic minorities living in communes in areas with difficult socio-economic conditions, areas with especially difficult socio-economic conditions, where these communes are determined to no longer be in areas with difficult socio-economic conditions, especially difficult conditions, the state budget will support the level of health insurance contributions. The level of support and the time of support for health insurance contributions are according to the Government's regulations".

According to delegate Dang Bich Ngoc, when implementing Decision No. 861/QD-TTg on approving communes in regions I, II, III in ethnic minority areas, in the period of 2021 - 2025, there were about 5.3 million people who did not have health insurance paid by the state budget, of which about 3.6 million ethnic minorities did not have health insurance. Since December 2023, after the Government issued Decree No. 75/2023/ND-CP, 1.5 million people have been granted health insurance cards with the state budget supporting 70% of the payment.

However, according to Decree No. 75/2023/ND-CP, the above subjects will only be supported for 36 months, meaning that they will no longer be supported by November 2026. It is expected that about 600,000 ethnic minorities will leave regions II and III in the next phase; about 2.1 million ethnic minorities will not be supported by health insurance policies. Therefore, it is necessary to include this content in the draft. Delegate Dang Bich Ngoc said that the Government needs to study the appropriate contribution level for the above subjects, ensuring that it does not reduce or lose the benefits of health insurance support compared to current regulations.

Delegate Ngoc also emphasized that currently, there is another subject that needs to be added to the regulation on state budget health insurance. That is people living in communes of safe revolutionary zones and communes of key national defense areas. With the duties and responsibilities of the people here to the country, it is proposed to add regulations on people living in communes of safe revolutionary zones and communes of key national defense areas to the group of subjects that are paid health insurance by the state budget right in this draft amended Law.

Assessing the responsiveness and balance of health insurance funds

Regarding the scope of benefits for health insurance participants as stipulated in Article 21, including 10 expense items: "expenses for the use of blood, blood products, drugs, medical equipment, medical gases, medical technical services, supplies, tools, instruments, chemicals used in medical examination and treatment". At the same time, the authority is assigned to the Minister of Health to promulgate the list, rates, and payment conditions for 3 contents including drugs, medical equipment, and medical technical services. According to delegate Dang Bich Ngoc, it is necessary to clarify the basis and maximum and minimum regulations on the payment rate for participants covered by health insurance to ensure the rights and transparency in the scope of benefits of participants.

Regarding the health insurance benefits in Article 22, the delegate said that the draft Law has expanded many benefits for health insurance participants and many proposed contents are covered by health insurance 100% of medical examination and treatment costs (both inpatient and outpatient). Especially in cases where patients can go to medical examination and treatment facilities with basic or specialized technical expertise in cases of diagnosis and treatment of some rare diseases, serious diseases, diseases requiring surgery or using high technology. However, it is recommended that the drafting agency carefully assess the ability to balance the health insurance fund and the ability to respond and balance the fund when adding many health insurance benefits as in the draft Law.

Review and adjustment between Data Law and legal documents

Also at the discussion session, contributing comments to the Data Law project, National Assembly Deputy Dang Bich Ngoc affirmed that the Draft Law has focused on solving important problems that are still stuck in current practice such as: infrastructure for deploying core information technology systems to serve professional work; many databases are collected, stored duplicately, overlapped, and inconsistently; lack of synchronous investment, not regularly checked, maintained, and upgraded, leading to the risk of not ensuring system security and safety; information technology infrastructure services are not really managed and controlled; difficulties in exploiting, connecting, and promptly providing data to serve the settlement of administrative procedures, connecting public services, analyzing statistics, and providing indicators and indicators to serve the direction and administration of the Government... However, it is necessary to review and adjust between the Data Law and legal documents to avoid overlaps and conflicts in implementation.

In addition, according to the delegate, in the viewpoint of drafting the Law, it has been determined that the application of data in state management and socio-economic development is a very urgent requirement, so data protection is particularly important, especially for big data. Currently, in the draft Law, there are many contents that require data protection. Therefore, the Drafting Committee needs to study and add the term "Data protection" to Article 1 of the draft to ensure regulations on measures and solutions for data protection.

Regarding prohibited acts (Article 9), delegate Ngoc said that in clauses 3, 4, 5, 6, the Drafting Committee needs to study and restructure them appropriately, because there are many overlapping contents. This will ensure the scientific and strict nature of the Law document.
