According to the Ministry of Construction , recently, the press has reported that many foreigners have rented and lived long-term in social housing projects in Bac Giang and Bac Ninh - places originally intended for workers and low-income people.
The Ministry of Construction cited, based on Clause 15, Article 75 of Decree No. 100/2024/ND-CP dated July 26, 2024 of the Government detailing a number of articles of the Housing Law on the development and management of social housing, and then requested the People's Committees of Bac Giang and Bac Ninh provinces to direct competent agencies to inspect, clarify and resolve, ensure proper implementation of legal provisions and report the results of the resolution to the Ministry of Construction before October 3, 2024.
Two Official Dispatches from the Ministry of Construction sent to the People's Committee of Bac Giang province and the People's Committee of Bac Ninh province.
Before receiving the dispatch from the Ministry of Construction, the People's Committees of Bac Giang and Bac Ninh provinces also directed departments, branches and localities to clarify the situation of foreigners living in social housing.
According to the provisions of the Housing Law, beneficiaries of social housing support policies include: People with meritorious services to the revolution, relatives of martyrs who are eligible for housing improvement support according to the provisions of the Ordinance on Incentives for People with Meritorious Services to the Revolution; poor and near-poor households in rural areas; poor and near-poor households in rural areas in areas frequently affected by natural disasters and climate change; poor and near-poor households in urban areas; low-income people in urban areas;
Workers and laborers working at enterprises, cooperatives, and cooperative unions inside and outside industrial zones; Officers, professional soldiers, non-commissioned officers of the people's armed forces, police workers, civil servants, defense workers and public employees currently serving in the army; people working in cryptographic work, people working in other cryptographic organizations receiving salaries from the state budget currently working;
Cadres, civil servants and public employees as prescribed by law on cadres, civil servants and public employees; Subjects who have returned official housing as prescribed in Clause 4, Article 125 of this Law, except for cases where official housing is revoked due to violations of the provisions of this Law.
Households and individuals whose land is recovered and whose houses must be cleared and demolished according to the provisions of law but have not yet received compensation from the State in the form of houses or residential land; Students of universities, academies, colleges, vocational schools, and specialized schools according to the provisions of law; students of public boarding schools for ethnic minorities; enterprises, cooperatives, and cooperative unions in industrial parks.
Therefore, the beneficiaries of social housing support policies do not include foreign workers working in Vietnam.
A social housing area in Bac Ninh
Previously, the Ministry of Construction sent a document to the People's Committees of localities to annually publish a list of individuals who are allowed to buy, rent, or lease social housing in the area to avoid taking advantage of the policy.
According to the report on the implementation of the Project to invest in building at least 1 million social housing apartments for low-income people and industrial park workers in the period of 2021-2030 of the Ministry of Construction, from 2021 to the end of August 2024, the whole country has completed 79 projects with more than 40,600 social housing units. Compared to the project's target of completing 428,000 social housing units in the period of 2021-2025, the number of completed houses is much lower, reaching only nearly 9.5%.
Currently, 128 projects have started construction (nearly 111,700 apartments) and 412 projects (more than 409,000 apartments) have been approved for investment. Thus, the number of apartments started and completed from 2021 to now reaches about 35.6% of the project's target set for 2025.
