Ms. Luu Thi Quynh Luong ( Hanoi ) asked, when determining the level of the project, calculating the total area of 17,000 m2 x 6 buildings, is the project level I or is 1 independent building considered a level II project?
The State Appraisal Department of Construction Quality, Ministry of Construction responded to this issue as follows:
According to current legal regulations, the level of construction works serving the management of construction investment activities (including special level, level I, level II, level III and level IV) is specified in detail in Circular No. 06/2021/TT-BXD dated June 30, 2021 of the Minister of Construction regulating the classification of construction works and instructions for application in the management of construction investment activities, which has been amended and supplemented in Circular No. 02/2025/TT-BXD dated March 31, 2025 of the Minister of Construction.
The construction level of an independent construction is determined according to the provisions in Clause 1 (on classification criteria) and Clause 2 (on how to determine construction level) Article 2 of Circular No. 06/2021/TT-BXD.
For projects with a number of independent main works (similar to the project mentioned in Ms. Luong's question), you can see how to determine the construction level and apply the construction level as presented in Example 3, Section 3.3, Appendix III, Circular No. 06/2021/TT-BXD.
According to the transitional provisions in Article 4 of Circular No. 06/2021/TT-BXD, in case the above social housing project has been decided for investment before the effective date of Circular No. 06/2021/TT-BXD, the level of construction work of the project is determined according to the provisions of law at the time of investment decision.
