On October 10, the Department of Culture, Sports and Tourism of Lam Dong province said it had sent an official dispatch to the People's Committees of communes, wards, special zones and tourism service businesses in the area regarding the business activities of "vacation ownership contracts".
The document emphasizes the goal of ensuring the rights of citizens and tourists , avoiding risks and dangers that may be encountered when signing this type of contract, which is showing many suspicious signs.
Strengthen propaganda and warning
The Department of Culture, Sports and Tourism of Lam Dong province requested the People's Committees of communes, wards and special zones to coordinate and direct relevant units to strengthen propaganda so that people can raise their vigilance about the dangers and risks when signing "vacation ownership contracts" with businesses and organizations that show signs of taking advantage of this activity to profit and defraud customers.
Localities are required to review and make a list of establishments and businesses that organize "vacation ownership contracts" business activities (if any), then report to the Department of Culture, Sports and Tourism for stricter management measures.
"Vacation ownership" is a service model that provides pre-purchase of vacation rights at one or several hotels or resorts for a certain period of time seasonally or continuously for many years, depending on the agreement signed between the parties.
This model has been deployed in Vietnam and attracted public attention. Besides the name "Holiday Ownership Contract", this activity also has other names such as "Resort Contract", "Family Vacation Contract", "Service Card Purchase Contract"...
Require business transparency
For tourism service businesses in the area, the department requires units that provide "vacation ownership" services to advertise and provide complete and accurate information in accordance with the law and have a full management mechanism.
The holiday purchase contract must be clearly established, without any terms that are unfavorable to the consumer such as limiting the buyer's right to complain, denounce, sue or terminate the contract.
Along with that, tourism service businesses need to be vigilant and grasp the specific programs of businesses renting or leasing premises and halls to organize conferences and seminars. When detecting suspicious or fraudulent "vacation ownership contract" business activities, they need to promptly report to the authorities for coordination and handling.
Recently, the "vacation ownership contract" business has become complicated with many signs and suspicions of customer fraud.
Some businesses and organizations take advantage of the lack of regulations, management mechanisms and tourists' trust to defraud and sign economic contracts with terms unfavorable to customers.
The tourism industry recommends that people be vigilant about this activity; learn about the legal status and service provision capacity of the business; carefully study the contract before signing, paying special attention to the terms related to customer rights, business responsibilities, contract value, related costs, contract termination terms and handling of violations.
