Many artists have apologized for false advertising, such as Hong Van and Quyen Linh. Apologies are good, but there are times when an apology, no matter how sincere, cannot resolve the consequences of wrongdoing.
For example, if people believe in the artist's advertisement and take all kinds of "medications" and health supplements, affecting their health and "losing both money and health", can that apology compensate for the damage to the victim?
Public opinion condemns artists who advertise products falsely, and proposes a permanent ban, but handling violations must be based on legal regulations. The law is not emotional, and does not deal with public opinion but with the law.
Therefore, to correct false advertising, we must apply the provisions of the law, not be lenient or lenient with anyone.
Vietnam has legal documents regulating this behavior, namely Decree 38/2021/ND-CP "Regulations on administrative sanctions for violations in the field of culture and advertising".
Specifically, for acts of advertising incorrectly or causing confusion about the business capacity, ability to provide products, goods, services of organizations and individuals trading in products, goods, services... will be fined up to 80,000,000 VND.
False advertising can be criminally prosecuted under Article 197 of the Penal Code: "Anyone who falsely advertises goods or services, has been administratively sanctioned for this act or has been convicted of this crime, has not had his/her criminal record expunged, and continues to violate, shall be subject to a fine of VND 10,000,000 to VND 100,000,000 or to non-custodial reform for up to 03 years."
This is the law, let's just punish them and see if anyone dares to advertise falsely.
