The biggest innovation in this draft Law on Science and Technology is the institutionalization of the viewpoints stated in Resolution 57-NQ/TW of the Central Committee on science, technology and innovation development.

In the past, investing in science and technology was like investing in regular spending activities. That way of doing things was administrative, not encouraging the exploration and creation of new things. Now, switching to investing according to the fund mechanism means accepting risks, accepting failure, even accepting investment, but not having the results as expected at first. That is the right investment mindset for science. This will motivate scientists to boldly embark on new topics, even if they are not sure of success. In case of success, the results can create completely new values, real scientific breakthroughs. That is what makes up the nature of scientific research: Searching for something that has never existed.

In addition, this draft law also opens a clearer path for the research process to be transformed into applied products. Support policies, such as technology transfer policies, transfer mechanisms, and mechanisms for confirming intellectual property rights in the field of science and technology, have also been clearly stipulated in the draft law. At the same time, this draft law clearly stipulates the exemption from criminal liability for cases of unsuccessful research. This provision is a form of encouragement for scientific activities to develop better.

Scientific research is a journey to create something new, something that has never existed before. Unsuccessful research also has a certain value. Thanks to that, others will not repeat the experiments that do not bring results, moving forward.

This draft Law on Science, Technology and Innovation was issued in a timely manner, following Resolution No. 193/2025/QH15 of the National Assembly on piloting a number of special mechanisms and policies to create breakthroughs in the development of science, technology, innovation and national digital transformation (Resolution 193), concretizing Resolution 57 of the Politburo on the development of science, technology and innovation (Resolution 57).

Immediately after Resolution 57 was issued, public opinion, voters, businesses and scientists all expected a clear legal framework for implementation. Resolution 193 was the first step, but due to limitations in the form of the document, it could not cover everything like a law. Therefore, amending the Law on Science and Technology in 2013 was necessary. This amendment is more comprehensive, clearly mentioning the role of businesses in research and development of science and technology.

Regarding administrative procedures, the new Law has drastically simplified, eliminated 9-11 old procedures, retained only two mandatory procedures and added 4 new procedures to suit practical activities. However, in the process of perfecting the law and its implementing documents, specific guidance is needed to avoid the situation where regulations are correct but difficult to implement. If regulations are well implemented, it will encourage the creativity of scientists.

The Draft Law on Science, Technology and Innovation has a notable new point, which is the regulation that scientists are entitled to 30% of the income generated from research results. This is a progressive policy, clearly demonstrating the view that science and technology are the key driving force for national development. This regulation recognizes the efforts, intelligence and real contributions of scientists, linking scientific research with practical application results.

In addition, sharing the benefits from research results is also a way to retain talent, especially in the context of competition for scientific resources not only domestically, but also internationally. The regulation that researchers are entitled to receive at least 30% of the income generated from research results is not really flexible.

In addition, the key point is to create a real science and technology market, connecting scientists and businesses. Previously, the State often invested in research, but the results were not close to social needs. The new law is opening the way for businesses to participate right from the testing stage, because businesses themselves understand what the market needs. However, clearer regulations are needed.
