Policies for people mobilized to participate in fire prevention and fighting
According to Article 32 of Decree 105/2025/ND-CP, the compensation and support policies for mobilized people and people participating in fire fighting, rescue and relief are as follows:
- People who are not part of the fire prevention, firefighting and rescue force when mobilized and participating in firefighting, rescue and relief operations are entitled to compensation as follows:
+ If the fire fighting, rescue and relief time is less than 02 hours, the minimum compensation is equal to 0.3 days of the regional minimum wage;
+ If the fire fighting, rescue and relief time is from 02 hours to less than 04 hours, the minimum compensation is equal to 0.45 days of the regional minimum wage;
+ If the fire fighting, rescue, or relief work lasts 4 hours or more, or the fire fighting, rescue, or relief work lasts for many days, then for every 4 hours, the minimum compensation is equal to 0.6 days of the regional minimum wage. If participating in fire fighting, rescue, or relief work at night from 10:00 p.m. to 6:00 a.m. the following day, it is calculated twice as much as above.
- The level that has the authority to mobilize will directly pay compensation to mobilized individuals within its management scope.
In case the participants in fire fighting, rescue and relief are not mobilized, the People's Committee at the commune level shall pay from the state budget.
- The regional minimum wage day is determined by the monthly regional minimum wage applicable to employees working in the area prescribed by the Government at the time of training and fostering in fire prevention, firefighting, rescue and first aid divided by 26 days.
Policies for people mobilized to participate in fire prevention, fire fighting, rescue and relief who have not participated in health insurance or social insurance and have accidents or injuries
According to Article 33 of Decree 105/2025/ND-CP, the regime and policies for mobilized people, people participating in fire prevention, fire fighting, rescue and relief who have not participated in health insurance or social insurance and have accidents or injuries are as follows:
- Medical examination and treatment cost support regime:
Mobilized people, people participating in fire prevention, fire fighting, rescue, and relief during the time of mobilization, participating in fire prevention, fire fighting, rescue, and relief, if having an accident or being injured, will be supported to pay for medical examination and treatment costs and daily meal allowance during the inpatient treatment period until their health is stable and they are discharged from the hospital at the same level as the support for members of the Security and Order Protection Team as decided by the Provincial People's Council.
- Allowance according to the level of reduced working capacity:
For mobilized persons, fire prevention, firefighting, rescue and relief workers who have accidents or injuries that reduce their ability to work, they will be paid a one-time allowance or monthly allowance, service allowance according to the level of reduced ability to work according to the conclusion of the Medical Assessment Council. The allowance level is equal to the one-time allowance or monthly allowance, service allowance for workers with reduced ability to work equivalent to the compensation level for workers who have occupational accidents that are not entirely caused by the worker himself/herself according to the provisions of the law on occupational safety and hygiene.
- Regime settlement profile:
+ In case of requesting support for payment of medical examination and treatment costs: application for payment of medical examination and treatment costs of the person receiving support for accident or injury regime or legal representative according to Form No. PC21 attached to Decree 105/2025/ND-CP; receipt; hospital discharge papers.
Information on the dossier components specified in this point, once connected, shared, and updated on the national database or specialized database, the competent authority must exploit it online for settlement without requiring the applicant to provide paper dossiers;
+ For cases requesting allowances based on the level of reduced working capacity: application for accident allowance according to Form No. PC22 attached to Decree 105/2025/ND-CP; hospital discharge papers or copies of medical records after accident treatment for inpatient cases or injury certificates issued by the medical facility where the emergency treatment was provided; minutes of assessment of the level of reduced working capacity by the provincial-level Medical Assessment Council or equivalent or higher.
- Resolution order:
+ The person requesting to enjoy the regime or the legal representative prepares 01 set of documents as above and submits it to the People's Committee at the commune level in one of the following forms: directly; via postal service; online via the public service portal.
The People's Committee at the commune level is responsible for receiving and checking the dossier; in case the dossier is invalid, it is responsible for providing immediate guidance for completion;
+ Within 05 working days from the date of receiving a complete and valid dossier, the People's Committee at the commune level is responsible for directing the appraisal organization and issuing a decision to pay medical examination and treatment support costs and allowances for accident and injured people.
In case the dossier is not eligible for settlement, the People's Committee at the commune level must have a written response, stating the reasons.
- The budget for implementing the above regimes and policies is guaranteed by the local budget.
Policies for mobilized people, fire prevention, firefighting, rescue and relief workers who have not participated in social insurance and die
According to Article 34 of Decree 105/2025/ND-CP, the regime and policies for mobilized people, people participating in fire prevention, fire fighting, rescue and relief who have not participated in social insurance and died are as follows:
- People who have not participated in social insurance or people who have received social insurance once and die due to participating in fire prevention, fire fighting, rescue or die during the first treatment period due to an accident while participating in fire prevention, fire fighting, rescue, the relatives organizing the funeral will be supported to pay for medical examination and treatment costs, death benefits and funeral expenses as follows:
+ Relatives are entitled to a one-time death benefit equal to the one-time death benefit when dying from a work-related accident according to the provisions of the law on occupational safety and hygiene or a monthly death benefit equal to the monthly death benefit for those participating in social insurance according to the provisions of the law on social insurance. Conditions for receiving a one-time death benefit or a monthly death benefit must ensure the conditions for relatives as prescribed by the law on social insurance for those participating in social insurance;
+ Relatives who organize the funeral will be paid funeral expenses. The amount paid is equal to the funeral allowance for people participating in social insurance according to the provisions of the law on social insurance;
+ In case of death during the first treatment period due to an accident while participating in fire prevention, fire fighting, rescue, or relief, relatives will be supported to pay for medical examination and treatment costs according to the provisions of Clause 1 and Clause 3, Article 33 of Decree 105/2025/ND-CP.
- Documents for settlement of death benefit and funeral allowance: application for death benefit and funeral allowance according to Form No. PC22 attached to Decree 105/2025/ND-CP; death certificate or death certificate extract.
Information on the dossier components specified in this point, once connected, shared, and updated on the national database or specialized database, the competent authority must exploit it online for settlement without requiring the applicant to provide paper dossiers.
- Resolution order:
+ Relatives of the deceased requesting to enjoy the regime or legal representatives prepare 01 set of documents as above and submit them to the People's Committee at the commune level in one of the following forms: directly; via postal service; online via the public service portal.
The People's Committee at the commune level is responsible for receiving and checking the dossier; in case the dossier is invalid, it is responsible for providing immediate guidance for completion;
+ Within 05 working days from the date of receiving complete and valid documents, the People's Committee at the commune level is responsible for directing the appraisal organization and issuing a decision on payment of regimes and policies.
In case the dossier is not eligible for settlement, the People's Committee at the commune level must have a written response, stating the reasons.
- The budget for implementing the above regimes and policies is guaranteed by the local budget.
Decree 105/2025/ND-CP takes effect from July 1, 2025.
