Preferential allowance scheme for teachers

I am an education administrator at an educational institution as stipulated in Articles 1 and 2 of Decree 61/2006/ND-CP, but I am not a teacher (my civil servant code is 01.002). I would like to ask if I am entitled to the preferential allowance as stipulated in Article 5 of Decree 61/2006/ND-CP? Bui Van Hung (buihung***@gmail.com)

The preferential allowance regime for teachers is implemented according to the regulations in Decision No. 244/2005/QD-TTg dated October 6, 2005 of the Prime Minister , and guided by Joint Circular No. 01/2006/TTLT-BGD&ĐT-BNV-BTC dated January 23, 2006.

Accordingly, teachers (including those on probation or under contract) who are on the payroll and directly teaching in public educational institutions within the national education system are eligible for the preferential allowance for teachers.

According to your letter, you are not a teacher and do not directly participate in teaching at the school, therefore you are not eligible for the preferential allowance for teachers as stipulated in Decision No. 244/2005/QD-TTg.

If you are working in a school located in an area with particularly difficult socio -economic conditions, you are eligible for preferential allowances as stipulated in Article 11 of Government Decree No. 76/2019/ND-CP dated October 8, 2019, which regulates policies for officials, civil servants, employees, and those receiving salaries in the armed forces working in areas with particularly difficult socio-economic conditions.

Specifically: The preferential allowance for the profession is equal to 70% of the current salary (according to the salary scale prescribed by the competent authorities of the Party and the State) plus leadership position allowance and seniority allowance exceeding the standard rate (if any), applied to the actual working time in areas with particularly difficult socio-economic conditions for the subjects specified in Article 2 of this Decree, including: Civil servants, public employees and workers who are teachers and educational management staff in educational institutions and vocational training institutions;

Public officials, civil servants, and employees directly engaged in medical professional work in state-owned medical facilities, including: commune-level health stations; health stations in agencies and schools; regional polyclinics; maternity homes, medical centers, hospitals, and other medical facilities from the commune level upwards.
