At Point e, Clause 1, Article 31 of the Law on Social Insurance 2014, it is stipulated that employees are entitled to maternity benefits when they fall into one of the following cases: Pregnant female employees; Female employees giving birth; Female employees being surrogate mothers and mothers requesting surrogacy; Employees adopting children under 6 months old; Female employees using IUDs, employees undergoing sterilization; Male employees paying social insurance whose wives give birth.
Employees specified in Points b, c and d, Clause 1 of this Article must pay social insurance for at least 6 months within 12 months before giving birth or adopting a child.
Employees specified in Point b, Clause 1 of this Article who have paid social insurance for 12 months or more, but when pregnant must take time off work to rest as prescribed by a competent medical examination and treatment facility, must pay social insurance for 3 months or more within 12 months before giving birth.
Clause 2, Article 34 of the Law on Social Insurance stipulates that male employees who are paying social insurance when their wives give birth are entitled to take leave to enjoy maternity benefits as follows: 5 working days; 7 working days when their wives have to undergo surgery or give birth under 32 weeks; In case the wife gives birth to twins, they are entitled to 10 working days off, from triplets or more, for each additional child, they are entitled to 3 more working days off; In case the wife gives birth to twins or more and has to undergo surgery, they are entitled to 14 working days off. The time off to enjoy maternity benefits prescribed in this clause is calculated within the first 30 days from the date the wife gives birth.
Based on the above regulations and your letter, if you give birth, your husband will be entitled to maternity leave. You need to understand the maternity benefits to contact the social insurance agency for answers and to request the implementation of legitimate and legal policies.
