Land acquisition is carried out in accordance with the provisions of law to implement the project in accordance with Bien Hoa urban development planning, contributing to changing the city's appearance and improving land use efficiency.
Move in July and before December
On April 8, the Provincial Land Fund Development Center had a working session with about 80 enterprises operating in production, business, and renting warehouses and factories at Bien Hoa 1 Industrial Park.
Here, Deputy Director of the Provincial Land Fund Development Center Le Thanh Dien said that based on the provisions of law, the resolution on the list of land acquisition projects of the Provincial People's Council, the decision approving the Project to Convert Bien Hoa 1 Industrial Park into an urban - commercial - service area and improve the environment of the Provincial People's Committee, the center has developed and issued a land acquisition plan.
According to the plan, the province will reclaim 298/320 hectares of land of the existing Bien Hoa 1 Industrial Park (the remaining area is land for traffic and public works). The purpose is to clear the land to create a clean land fund for auctioning land use rights, investing in the construction of the Provincial Political - Administrative Center and building the Bien Hoa 1 urban - commercial - service area in accordance with the planning orientation of Bien Hoa urban development, contributing to changing the appearance of the city's landscape and improving land use efficiency.
According to the Department of Agriculture and Environment, Bien Hoa 1 Industrial Park currently has 76 enterprises leasing land and infrastructure for operation; of which 67 enterprises have the longest land lease term until 2051. |
According to the Deputy Director of the Provincial Land Fund Development Center, the time for compensation, support, resettlement, and land recovery will not exceed 8 months from the date of issuance of the land recovery notice. The specific roadmap is: for the nearly 9-hectare land plot (belonging to Area I with an area of 75 hectares), the recovery for land use rights auction will be completed in July 2025; for the 28-hectare land plot recovered to build headquarters of agencies (belonging to the 105-hectare Provincial Political - Administrative Center area) will be completed in July 2025; the remaining areas will be completed before December 2025. Thus, there are 2 time points: in July and before December.
Director of the Provincial Land Fund Development Center Mai Phong Phu said that the land recovery of organizations, households and individuals will be carried out according to the procedures and regulations of the law. The first step is to hold a meeting to disseminate the land recovery plan to people and businesses and receive opinions. Next is to issue a notice of land recovery; investigate, survey, measure, count; establish, appraise, approve and publicize the compensation, support and resettlement plan; implement the compensation, support and resettlement plan. Finally, the land recovery. Each step and stage has a different time frame, ensuring the correct order and regulations.
Ensure maximum benefits for land users
Regarding the above land recovery plan, representative of Fashion Garments 2 Company Limited Pham Truong Giang said that because this is a long-standing industrial park, each enterprise operating in the industrial park has different land and construction records; some enterprises lease land directly from the State, some enterprises sublease land from infrastructure business companies. Therefore, the authorities need to consider all factors to have appropriate compensation and support policies. Mr. Giang suggested that when developing compensation and support plans, the authorities should consider the difference in land rental costs, construction of new factories, and asset depreciation when relocating.
Director of Bibica Joint Stock Company Factory Vo Quoc Khom said that Bibica is a facility with a long history of operation in Bien Hoa 1 Industrial Park. The land lease term according to the enterprise's contract is until 2051, but now it must be relocated. Mr. Khom proposed to soon have a plan for compensation, support, and resettlement; the provincial authorities should create conditions to quickly resolve procedures on investment, environment, 1/500 planning, construction, fire prevention and fighting for the enterprise's new factory project.
At this conference, Ms. Pham Thi Thu Van, representative of Southern Agricultural Machinery and Engine Company Limited (Vikyno & Vinappro), said that according to current regulations, the policy of supporting damages due to relocation of production and business facilities only applies to cases of land lease with one-time payment. Meanwhile, most enterprises in Bien Hoa 1 Industrial Park lease land with annual payment. Ms. Thu Van proposed that the province consider allowing enterprises that lease land annually to receive relocation damages support like enterprises that lease land with one-time payment; and have a policy of tax exemption or reduction or land rent in the first few years for newly relocated factories.
Sharing with enterprises, the Director of the Provincial Land Fund Development Center said that land acquisition to convert the function of this industrial park is a major policy of the province, which has been in place for many years. Recently, some enterprises have proactively relocated their factories to other locations and stabilized production. Currently, the province has identified this as an urgent project that needs to be implemented quickly.
The conference to disseminate this plan is the first step to inform and record the opinions, recommendations, and wishes of enterprises to serve the development of compensation and support plans. Before having a complete plan and issuing a notice of land recovery, the competent authorities and consulting units will work with each enterprise, inventory and evaluate the assets, machinery, and construction works of the enterprise to have a compensation and support policy that is fair, reasonable, and in accordance with the law.
