LACK OF INSPECTION, SUPERVISION, LOOSE MANAGEMENT

The Government Inspectorate said that over the past 5 years, the Ministry of Industry and Trade has issued 37 licenses for petroleum import and export (excluding 4 licenses for aviation petroleum) and 347 licenses for retail distribution.

One of the conditions for being licensed as a petroleum trading enterprise, according to Decree 83/2014, is that they must have a warehouse or petroleum tank or rent it from another unit for 5 years or more. This leads to the fact that enterprises and distributors rent warehouses seasonally to be granted a license. This is one of the reasons for violations of the Ministry of Industry and Trade 's licensing, according to the inspection conclusion.

In fact, after being licensed, many key traders have not been able to ensure the distribution system of gasoline. Many warehouse and tank rental contracts have not generated shipments, contract liquidation... affecting the market supply.

"The Ministry of Industry and Trade has lacked inspection, supervision, lax management and failed to promptly detect violations in maintaining warehouse conditions, tanks and distribution systems," the inspection conclusion stated.

MANAGEMENT AND USE OF THE PETROLEUM PRICE STABILIZATION FUND HAS MANY DIFFICULTIES

In addition, the management and use of the Petroleum Price Stabilization Fund also has many shortcomings. According to the inspection results, the agency managing the Petroleum Price Stabilization Fund still shirks responsibility; there is a lack of regulations, coordination rules, and assignment of tasks between the presiding agency and the coordinating agency ( the Ministry of Finance presides over and coordinates with the Ministry of Industry and Trade) in managing the fund, inspecting and supervising the implementation of legal regulations on the fund by key petroleum traders.

Up to 7/15 key petroleum traders used the price stabilization fund for the wrong purpose of price stabilization, did not transfer it to the price stabilization fund account, and left it in the business's regular payment account for many periods before returning it to the price stabilization fund with an amount of more than VND 7,927 billion.

According to the inspection results, data from the General Department of Taxation (Ministry of Finance) shows that as of October 31, 2022, a number of key petroleum traders still owed and had not paid the state budget more than VND 6,323 billion in environmental protection tax.

As of September 30, 2022, 6/15 inspected petroleum traders owe environmental protection tax of more than VND 3,219 billion.

Although still owing the state budget environmental protection tax, some key petroleum traders have lent and owed thousands of billions of dong to individuals for personal use.

TRANSFERRING 3 CASE FILES TO MINISTRY OF PUBLIC SECURITY

Also in the conclusion, the Government Inspectorate transferred the files of 3 cases to the Ministry of Public Security for consideration and handling according to legal regulations. First, violations of the law in declaring and paying environmental protection tax on gasoline and oil, the use of the Petroleum Price Stabilization Fund (BOG) at Thien Minh Duc Group Joint Stock Company. Second, violations of the law in declaring and paying environmental protection tax on gasoline and oil at Xuyen Viet Oil Trading, Transport and Tourism Company Limited. Third, violations of the law in declaring and paying environmental protection tax on gasoline and oil; the use of the BOG Fund for the wrong purpose of price stabilization at Hai Ha Water Transport Company Limited.

The Government Inspectorate has also transferred information and documents to the Ministry of Public Security's Investigation Agency for consideration and handling in accordance with the law regarding a number of contents discovered during the process of collecting information and documents. That is the act of violating the law in contributing capital to establish Phuoc Khanh Petrochemical Joint Stock Company, discovered through the collection of information and documents at Dong Thap Petroleum Trading One Member Limited Liability Company.

Regarding handling of responsibilities, the Government Inspectorate recommended that the Prime Minister direct the Ministry of Industry and Trade and the Vietnam Oil and Gas Group (PVN) to organize a review and handle responsibilities according to Party regulations and State laws for organizations and individuals related to shortcomings and violations.

The Government Inspectorate transfers the conclusion of the petroleum management inspection to the Central Inspection Committee for consideration and handling according to its authority with cadres under the management of the Politburo and Secretariat.
