According to the Provincial People's Committee, Decree No. 65/2023/ND-CP of the Government detailing a number of articles and measures to implement the Law on Intellectual Property (IP) on industrial property, protection of industrial property rights, rights to plant varieties and state management of IP (referred to as Decree 65) plays an important role in concretizing the provisions of the Law, creating a clearer, more transparent and effective legal corridor for IP activities.

After nearly 2 years of implementation, Decree No. 65 has had positive impacts on IP activities in Dong Thap province. In the state management of IP, the Provincial People's Committee has widely disseminated the Decree in many forms, contributing to raising awareness of organizations and individuals, especially businesses and the research community, about the importance of IP and related legal regulations. At the same time, the Provincial People's Committee directed the Department of Science and Technology to promptly and detailedly guide the process and procedures related to registration, management and enforcement of IP rights, making it easier for entities to carry out procedures related to trademarks, industrial designs, patents, copyrights and related rights.
Up to now, the whole province has successfully established rights for 1 geographical indication (Cao Lanh geographical indication for mango products), 36 certified trademarks (26 trademarks for specific agricultural products, 10 trademarks with place names for other services and tourism ), 4 collective trademarks serving production and business, promoting local images. In addition, there are a number of typical provincial and local goods that are undergoing registration procedures to establish rights at the Department of Intellectual Property. Specifically: geographical indication "Dong Thap" for lotus products; certified trademarks: "Cao Lanh durian", "Cu Lao Tay mango", "Chau Thanh longan - Dong Thap", "Chau Thanh durian", "Tam Nong crane rice".
Regarding management activities, permission to use place names to register collective trademarks and certification trademarks in the province is implemented according to Decision No. 1518 dated October 6, 2021 of the Provincial People's Committee stipulating criteria for registration of rights to certification trademarks and collective trademarks for specific agricultural products of the province. Activities of ownership and management rights for geographical indications are implemented according to Decision No. 1163 dated October 25, 2022 of the Provincial People's Committee promulgating the Regulation on coordination in creating, managing and developing geographical indications in Dong Thap province to specify policies on developing IP in the locality. Currently, Dong Thap has registered to establish rights (protection) for the geographical indication "Cao Lanh" for mango products, managed by the Department of Agriculture and Environment.
Recently, Dong Thap province has guided and supported 64 organizations and individuals to register inventions and industrial designs, and the National Office of Intellectual Property has granted 41 protection certificates for the period 2021 - 2025.
In addition, in order to develop local and rare indigenous specialty crops, Dong Thap organizes the selection and recognition of parent trees and parent tree gardens for 4 types of seedlings: Cat Hoa Loc mango, Cat Chu mango, Chau Thanh longan (Idor) and Hoa An plum, pink tangerine; parent tree garden of latex-free MICA star apple. Currently, there are no plant varieties in the province that have been granted protection certificates, so there have been no records of administrative violations in the implementation of protection of rights to plant varieties.
After nearly 2 years (from August 23, 2023 to May 2025), the implementation of Decree No. 65 has shown initial positive impacts in specifying and guiding the implementation of the amended and supplemented Law on Intellectual Property. The Decree contributes to increasing transparency and specifying the process, clarifying many regulations on registration procedures, management and enforcement of intellectual property rights, making it easier for subjects to exercise their rights and obligations; raising awareness of intellectual property, attracting attention and raising awareness of the community and businesses about the role of intellectual property; creating a legal basis for newly amended activities in the Law on Intellectual Property, creating a legal corridor for activities related to rights protection and combating unfair competition in the field of intellectual property; promoting increased registration of trademarks and industrial designs.
In addition to the advantages, the implementation of Decree 65 still faces certain difficulties and obstacles. In this situation, the province has made a number of proposals and recommendations. For solutions to improve the effectiveness of state management of intellectual property, it is necessary to have a close coordination mechanism between ministries, branches and localities in promulgating and guiding the application of legal documents on intellectual property, ensuring consistency and uniformity nationwide. Building and upgrading the intellectual property database system, applying modern technologies (AI, big data) in monitoring, detecting and handling acts of infringement of rights in the digital environment. At the same time, building intellectual property trading floors, supporting intellectual property valuation, connecting rights owners with investors and businesses in need of exploitation.
Regarding solutions to improve the effectiveness of protecting industrial property rights and rights to plant varieties, it is necessary to organize in-depth training courses on intellectual property law and skills in detecting and handling violations for enforcement officers.
In addition, the province proposed and recommended that the ministries and branches of the Ministry of Industry and Trade, the Ministry of Science and Technology, the Ministry of Culture, Sports and Tourism, the Ministry of Public Security, and the General Department of Customs establish an effective and regular coordination mechanism between state management agencies in the work of preventing and combating infringement of intellectual property rights; strengthen cooperation with international organizations and countries with developed intellectual property systems to exchange experiences, learn effective management and enforcement models, etc.
