Some illegal construction items on agricultural land with a total violation area of ​​360,585m2 of Mr. Nguyen Xuan Tung in Ke hamlet, Hien Luong commune (Da Bac) were requested to temporarily stop construction.

As the car accelerated to overcome the steep slope, right behind the entrance to Ke hamlet was a land area of ​​hundreds of square meters deep into the hillside, forming a steep slope with construction works in disarray, with many construction items assembled with formwork, tied with iron nets, preparing to pour concrete. Below the land was a dry stream, almost filled with soil. Pointing to the dry stream, a resident looked worried: this season the stream has no water, but when it rains, water from the mountains will rush down and create a rapid flow. Like the third storm in 2024, this stream had a big flood that threatened the lives of people below. Currently, people are dumping soil, almost filling up the old stream bed, so who knows where the water will go when it rains heavily? Are the houses of the people, even the construction items under construction here, still safe?

Not only this project, following the instructions of the people, we continued to climb the slope, approaching the top of the slope, we encountered a large-scale construction project, in the form of a homestay service business area. People living nearby said that this project was built by a person named Nguyen Xuan Tung in Hanoi who bought land and invested in construction. Previously, on the land of a household, people also built houses and grew corn, after selling it, they moved to another place. The buyer then used machinery to excavate, bulldoze, and level the ground on an area of ​​up to tens of thousands of square meters. After completing the leveling of the ground, the investor built a number of projects to initiate and serve the homestay business, including a central stilt house with an area of ​​about 100 square meters, 2 panorama swimming pools (infinity) facing the lake with an area of ​​about 100 square meters, 4 separate solidly built houses (construction completed, not yet roofed)...

Here, we met a man named Minh who was hired by the investor to look after, protect, and take care of newly planted trees in the renovated and leveled land. Mr. Minh said that the investor renovated and leveled this land since the beginning of 2024. Previously, the land was rough and bumpy, the investor had to hire an excavator to work continuously for nearly 2 months to complete the renovation. The renovated and leveled area was up to tens of thousands of square meters and construction of works and items began around April 2024. Up to now, the rough construction has been basically completed, some items are in the finishing stage. Due to not being able to hire workers, the project has temporarily stopped construction. Currently, the investor is looking for workers to complete the construction, it is expected that by September 2, 2025, the project will be completed, put into operation, and welcome guests...

According to the information we have collected and provided by the people, the leveling and improvement of the current land status of this project has been taking place since the beginning of 2024. From mid-April 2024 to early May 2024, the People's Committee of Hien Luong commune discovered that the investor, Mr. Nguyen Xuan Tung (born in 1983), residing in Van Quan ward, Ha Dong district (Hanoi), had built solid structures, including house foundations and auxiliary structures exceeding the residential land area in the land use right certificate, including the construction of 3 level 4 house foundations and 1 outdoor water tank. At the time the People's Committee of the commune discovered the construction of the new project in the initial stage of pouring the foundation, the People's Committee of Hien Luong commune had drawn up a record of violations with a total construction area of ​​3 foundations of 268m2; The area of ​​land that was arbitrarily converted to a purpose is 286.86 square meters (133 square meters of land use changed to residential land, and 153.86 square meters of outdoor swimming pool construction). At the same time, Mr. Nguyen Xuan Tung is required to immediately stop the violation; and the original state of the land before the violation is restored.

However, it is not known whether it is due to the lack of management, supervision, monitoring, lax management of land and construction order by the Commune People's Committee, or for some other reason, but by December 2024, when re-inspecting the project, it continued to build solid items, and continued to arbitrarily change the land use purpose. Accordingly, in the working minutes dated December 27, 2024, the inspection team of the Hien Luong Commune People's Committee requested Mr. Nguyen Xuan Tung and Mr. Dinh Cong Tien (born in 1980), residing in Ke hamlet, Hien Luong commune (the person authorized by Mr. Nguyen Xuan Tung) to temporarily stop construction on the violating area of ​​360.585m2. Of which, there are 206.725m2, including 4 houses with completed rough construction (no roof, no doors) and 1 outdoor swimming pool with an area of ​​153.86m2.

Discussing this issue, Comrade Bui Van Ky, Chairman of the People's Committee of Hien Luong Commune, said that because he had just been transferred to the position of Chairman of the People's Committee of the Commune for about 3 months, he did not fully understand the incident. This incident was beyond the authority of the Commune, so the People's Committee of the Commune reported to the District People's Committee for consideration and resolution. The Commune requested the investor to strictly comply with the suspension of construction on the illegally converted area until there is a conclusion from the competent authority.

Comrade Dao Tien Quyet, Head of the Department of Agriculture and Environment of Da Bac district, said: In the case in Ke hamlet, Hien Luong commune, the unit is carrying out procedures, determining the level of violations of organizations and individuals to advise the Chairman of the District People's Committee to make a decision to handle according to authority, from the viewpoint that agencies, organizations and individuals who commit mistakes must be responsible and handled according to the provisions of law. In addition, the District People's Committee has issued many documents directing localities to strengthen the management of areas, management of construction order, land and minerals. Do not let people arbitrarily change the purpose of land use, build illegal works on forest land and agricultural land, especially in areas and areas sensitive to economic development and tourism in the locality.
