There are about 100 projects in Ho Chi Minh City 'waiting' for land use fee notification.

According to the Ho Chi Minh City Real Estate Association, the entire city currently has about 100 real estate and commercial housing projects "waiting" for competent state agencies to announce 'land use fees, additional land use fees' (if any).

In a document providing comments on the draft resolution of the National Assembly stipulating a number of mechanisms and policies to remove difficulties and obstacles in organizing the implementation of the Land Law, the Ho Chi Minh City Real Estate Association (HoREA) recently proposed to exempt additional fees related to land use and land rent for enterprises that are not at fault, in order to avoid unexpected financial obligations.

HoREA explains that land users are considered not at fault in cases where at the time of issuance of land price decisions there is no document or decision of a competent state agency determining the land user's fault.

In case the conclusion is later that the enterprise is in violation, the additional amount and late payment will be calculated. For enterprises that have paid but are not at fault, the competent authority can deduct this amount from other financial obligations.

And according to the Ho Chi Minh City Real Estate Association, this change (if approved) will have a positive impact on the investment environment, especially attracting foreign direct investment (FDI), directly in the real estate sector.

The proposal was further emphasized by HoREA when in reality, many projects are currently facing difficulties with new regulations that may force businesses to pay additional land use fees even though they have not violated the law.

This arises mainly due to delays in issuing land price decisions and land use fee notifications from state agencies, while businesses cannot intervene in the pricing or planning adjustment process.

HoREA's document clearly states that in Ho Chi Minh City alone, there are currently about 100 projects where real estate and commercial housing project investors are "waiting" for competent state agencies to notify "land use fees, additional land use fees" (if any).

Some notable cases include Novaland with 13 projects, Hung Thinh Land with 8 projects and a series of other projects such as the Empire City Observation Tower of the Imperial City joint venture. Particularly, the Thu Thiem Eco Smart City project of Lotte Properties HCMC was once required to pay an additional 2,600 billion VND, even though the contract was signed in 2017 - a time when the 2013 Land Law did not yet stipulate this obligation.
