The discussion session at Group 11 was chaired by comrade Hoang Duy Chinh, member of the Party Central Committee, Secretary of the Provincial Party Committee, Head of the National Assembly Delegation of Bac Kan province, with the participation of delegates from the National Assembly Delegations of Bac Kan, Long An, Son La, and Vinh Long provinces.

At the meeting, National Assembly delegates from Bac Kan Delegation made profound comments on specific contents stipulated in the draft laws.

Delegate Nguyen Thi Thuy, Vice Chairwoman of the National Assembly's Committee on Law and Justice (National Assembly Delegate of Bac Kan province) agreed with the scope of amendments and supplements in the draft Law amending and supplementing a number of articles of the Law on Organization of People's Courts and the draft Law amending and supplementing a number of articles of the Law on Organization of People's Procuracies, in order to promptly implement the Party's conclusions and resolutions on the organization of the People's Courts and People's Procuracies.


Delegate Thuy said: Reorganizing the People's Procuracy and People's Court system into a three-level model instead of the current four-level model is the right direction, in line with the organization of district-level government, in line with the current practical requirements for reforming the apparatus. However, the delegate suggested that it is necessary to continue to comprehensively review the relevant provisions in the above two draft laws to ensure consistency, avoid partial and inconsistent amendments. In addition to the amended provisions in the current draft, many other relevant provisions also need to be updated to properly implement the spirit of the Central Committee's conclusion.

Regarding the Law on the Organization of the People's Procuracy, regarding the content of the amendment to the prosecutor system, delegate Thuy said that the addition of open provisions on "other duties and powers" of prosecutors is not strict enough, easily leading to the situation where non-professional cadres are still appointed to judicial positions, reducing the prestige and professionalism of the prosecution system. The delegate proposed to add two articles to the draft Law on the Organization of the People's Procuracy: First, specify the duties and powers of the Supreme People's Procuracy prosecutors; Second, clearly define the duties of the remaining prosecutor ranks (primary, intermediate, senior), ensuring transparency, consistency and avoiding abuse in the implementation.

In addition, regarding the issue of changing the names of prosecutors from "intermediate prosecutor" to "chief prosecutor", "primary prosecutor" to "prosecutor", delegate Thuy proposed to keep the current names to be consistent with other judicial laws such as the Law on Organization of Criminal Investigation Agencies, the Law on Civil Judgment Enforcement. Changing the name without changing the nature can easily disrupt the system of documents and papers, causing waste and being unnecessary.


Concerned about the regulations on the organizational structure of the People's Procuracy, delegate Ha Sy Huan, member of the Provincial Party Committee, Deputy Head of the Delegation of National Assembly Deputies of Bac Kan province, said that the regulations on the organizational structure of the regional People's Procuracy and the regional Military Procuracy in the draft law are not consistent (where there are/are not offices, departments), so he suggested that the drafting agency study and adjust to unify the organizational structure of these two types of procuracies, ensuring consistency and suitability with reality.

Regarding the draft Law on Inspection (amended), delegate Ha Sy Huan said that the regulations on the duties of the Provincial Inspectorate stipulated in the draft stated: "inspecting the compliance with the law in the fields under the state management of the departments". However, currently, local departments and branches mainly play the role of advisory bodies for the Provincial People's Committee in state management, not as direct implementing agencies. Therefore, the delegate proposed to amend this regulation so that the inspectorate is responsible for compliance with the law in the work, in the fields advised by the departments and branches under the state management of the Provincial People's Committee to be appropriate, ensuring that it accurately reflects the current roles and functions of local departments and branches.

Analyzing the regulations on the authority to sanction administrative violations, delegate Huan pointed out that the current draft stipulates that there are three positions authorized to sanction administrative violations, including: The person who makes the inspection decision, the head of the inspection team and the inspector. However, according to the current Law on Handling Administrative Violations, the "person who makes the inspection decision" does not have the authority to issue decisions on sanctioning administrative violations. Therefore, the delegate proposed to consider regulations to increase the authority to sanction administrative violations for the Chief Inspector or to amend the current Law on Handling Administrative Violations to ensure consistency and uniformity.


With 08 delegates participating in the discussion, the Discussion Session at Group 11 demonstrated the high sense of responsibility, frankness, closeness to reality and enthusiasm of the delegates for the work of law-making. Specific and constructive comments will contribute to perfecting the draft laws, ensuring feasibility, synchronization and conformity with the requirements of reforming the organization of judicial agencies in the new period./.
