Policy consultation conference on building the Law on E-commerce took place on the afternoon of April 9.
At the policy consultation conference on the development of the Law on E-commerce held on the afternoon of April 9, Ms. Le Hoang Oanh, Director of the Department of E-commerce and Digital Economy, said that in the process of proposing the development of the Law on E-commerce, the Ministry of Industry and Trade has developed 5 sets of documents including: Proposal for the development of the law; impact assessment report; policy review report; summary report on the implementation of current laws and policy standardization report.
The Ministry of Industry and Trade has also asked for public opinions on the law-making dossier on the Government 's electronic information portal, the Ministry of Industry and Trade's electronic information portal, and has asked for written opinions from all relevant agencies and units.
To date, the Ministry of Industry and Trade has received comments from more than 90 agencies, organizations, units and localities, including 20 ministries, branches and agencies of the Government, 63 comments from People's Committees of provinces and centrally-run cities, the Vietnam Federation of Commerce and Industry , associations and a number of business organizations.
"The comments basically agreed with the need to issue a separate law on e-commerce. At the same time, they basically agreed with the five policies in the proposal to build the Law on E-commerce.
On April 4, 2025, the Ministry of Industry and Trade sent the Ministry of Justice a proposal to add the Law on E-commerce to the National Assembly's legislative agenda for 2025. At the same time, it proposed that the draft law be passed in October 2025," said Ms. Le Hoang Oanh.
5 major policies proposed
Also according to Ms. Le Hoang Oanh, based on the assessment of practical implementation, identifying necessary contents that need to be supplemented and completed to plan e-commerce policies in the coming time, the Ministry of Industry and Trade identified 5 major policies, specifically:
Firstly, supplement and unify concepts according to current legal regulations. The policy aims to clearly define the concepts of digital platforms, intermediary digital platforms and other concepts suitable for the e-commerce sector and ensure harmony with other current laws; ensure consistency and unity in the legal system.
Second, regulating forms of e-commerce activities, subjects participating in e-commerce activities, related rights and obligations with the aim of ensuring that no e-commerce activity models and subjects are left out; ensuring transparency in authority, clarity in the limits of responsibility of state management agencies, and promoting decentralization among state management agencies in the field of e-commerce.
Third, the responsibility of e-commerce support service providers is to create a mechanism for competent state management agencies to implement technical measures to prevent information about goods and services that violate e-commerce laws; create a mechanism for competent state management agencies to request e-commerce support service providers to sign service provision contracts with e-commerce platforms.
Fourth, regulations on electronic contract authentication services in commerce with the goal of fair treatment for types of reliable service providers; quickly detecting and handling violations of laws related to electronic contracts.
Fifth, regulations on the construction and development of e-commerce aim to institutionalize the viewpoints, policies and guidelines of the Party and Government on promoting the development of e-commerce; promote green and sustainable development of e-commerce, contribute to effective economic development, create value for the community, contribute to building a fair society and minimize negative impacts on the environment.
In recent years, Vietnam's e-commerce has grown strongly. The e-commerce retail market is currently the third largest in Southeast Asia, reaching about 25 billion USD.
Of the total size of Vietnam's digital economy of 36 billion USD, e-commerce accounts for 2/3. Notably, in terms of growth rate, Vietnam is currently ranked 5th in the world.
