Proposal to add fundamental principles for the organization of the Front in the new model

On June 13, continuing the 9th Session, the National Assembly discussed in the hall the Draft Law on amending and supplementing a number of articles of the Law on the Vietnam Fatherland Front, the Law on Trade Unions, the Law on Youth and the Law on Implementing Democracy at Grassroots Level. Many delegates emphasized that this amendment needs to be comprehensive, in line with reality, ensuring legal unity, creating a solid legal basis for the operation of the political system and promoting the people's right to mastery.

The majority of National Assembly deputies agreed on the necessity of promulgating the Law amending and supplementing a number of articles of the Law on the Vietnam Fatherland Front, the Law on Trade Unions, the Law on Youth and the Law on Grassroots Democracy Implementation (the Law amending and supplementing 4 Laws) with a scope directly related to the arrangement of the organizational apparatus; position, role, functions, principles and organization of activities of the Vietnam Fatherland Front, socio- political organizations, and mass associations assigned by the Party and State in the Law on the Vietnam Fatherland Front, the Law on Trade Unions, the Law on Youth and the Law on Grassroots Democracy Implementation.

According to the Vietnam National Assembly Portal, participating in giving comments on the content of amending and supplementing a number of articles of the Law on the Vietnam Fatherland Front, delegate Nguyen Thi Suu (Hue City delegation) found that the amendment of Clause 3, Article 4 on the Principles of Organization and Operation of the Vietnam Fatherland Front still lacks sustainable fundamental principles, consistent with the new organizational model and operational structure of the Vietnam Fatherland Front and its member organizations. Therefore, the delegate proposed to add a number of principles on the organizational structure of the Vietnam Fatherland Front Committee, the Party's leadership principles for the Vietnam Fatherland Front Committee, the principles on coordination with the Government and relevant agencies, the principles on implementing foreign policies, the principles of gathering forces in peacetime and emergency situations.

Delegate Nguyen Thi Suu also said that in the current context, it is necessary to include in the draft Law amending Article 32 of the current Law related to the social criticism activities of the Fatherland Front.

“I believe that, after the amendment, the Vietnam Fatherland Front and its member organizations will continue to promote their core role in building the great national unity bloc, effectively implementing social supervision and criticism, participating in Party building, government building, protecting the legitimate rights and interests of the people and international integration in the new situation,” said delegate Nguyen Thi Suu.

Commenting on the content of amending and supplementing a number of articles of the Trade Union Law, delegate Duong Minh Anh (Hanoi City delegation) said that it is unreasonable to stipulate: The subject must contribute 2% of the salary fund as the basis for compulsory social insurance for employees, including public service units that do not receive 100% of their salary from the state budget, at point b, clause 1, article 29 of the draft Law.

According to the delegate, such a regulation is understood to mean that only public service units whose regular and investment expenses are 100% guaranteed by the state do not have trade unions and do not have to pay trade union fees. The remaining public service units must have trade unions and pay trade union fees. Giving reasons for this opinion, the delegate suggested that it is necessary to ensure policy consistency within the same subject.

“The drafting committee should consider removing the subject of public service units that do not receive 100% of their salary from the state budget from point b, clause 1, Article 29 of the draft Law. This means removing from the draft Law all contents related to grassroots trade union organizations at public service units,” delegate Duong Minh Anh suggested.

Regarding the content of amending and supplementing a number of articles of the Law on Implementing Democracy at the Grassroots Level, delegate Duong Minh Anh said that, in order to ensure consistency in the legal system, the drafting committee should remove the subject of civil servants and public employees in all articles of the current Law on Implementing Democracy at the Grassroots Level, and remove the phrase "public service units" from point a, clause 2, Article 83 of the draft Law. In addition, according to the delegate, the drafting committee should design transitional provisions to assign the Vietnam General Confederation of Labor to guide the implementation of this Law for units without trade unions.

Explaining at the meeting hall, Chairman of the Central Committee of the Vietnam Fatherland Front Do Van Chien said that the Drafting Committee would fully absorb the opinions of National Assembly deputies to continue perfecting the draft Law to submit to the National Assembly for consideration and decision.

Mr. Do Van Chien also said that the draft Law amending and supplementing 4 Laws drafted by the Central Committee of the Vietnam Fatherland Front has closely followed and correctly implemented the Party's policies, referring to the provisions of the Constitution. The National Assembly's consideration and decision to amend and supplement the Law on the Vietnam Fatherland Front, the Trade Union Law, the Youth Law, and the Law on Grassroots Democracy at this session are very important contents to successfully implement the Party and State's policy on the revolution of streamlining the apparatus to be compact, strong, efficient, effective, and efficient; creating a legal basis for the activities of the Fatherland Front, socio-political organizations, and promoting the people's mastery.
