Proposal to assign 'identification code' to real estate from 2026

The Ministry of Construction proposed to create real estate codes and manage them on the information system.

The above proposal is stated in the draft Decree on the construction and management of the database on housing and real estate market which is being consulted.

The draft Decree regulating the construction and management of information systems and databases on housing and real estate markets consists of 06 chapters and 47 articles. In addition to general provisions, the draft clearly states specific provisions on information technology infrastructure and software systems; databases on housing and real estate markets; providing, sharing, connecting information and data, ensuring the quality of the housing and real estate market information system; managing, exploiting, and publishing information...

Each real estate project will automatically be assigned a unique code.

Accordingly, the Ministry of Construction proposed to create real estate codes and manage them on the information system. Each real estate project will automatically be assigned a unique code, ensuring identification and no change throughout the data life cycle.

The provincial specialized agency will initiate this code in the area at the time the project is approved, and continue to link and update data with each product in that project.

The information fields that make up the real estate project code include the investor, location, scale, total investment capital, operating period, progress and legal documents (investment approval, investor selection, detailed planning, construction permit...).

In addition to commercial housing and social housing, this data also includes many specific types such as worker accommodation in industrial parks, public housing, resettlement housing, housing for armed forces, rental housing invested by households or businesses, and housing sold to foreign organizations and individuals.

Regarding the implementation roadmap, the Ministry of Construction proposed the preparation phase from the fourth quarter of 2025, piloting in 5 cities including Hanoi , Ho Chi Minh City, Hai Phong, Da Nang and Can Tho.

The first two quarters of 2026 will be the technical implementation and data update phase. The management agency will integrate data to synchronize with the National Information System on Housing and Real Estate Market. Information collection, updating and data storage will be implemented during this phase, ensuring timeliness and security.

From the third quarter of 2026, the information system is expected to be tested internally and officially operated from the fourth quarter of next year. The management agency will periodically evaluate the results of the implementation, completion and maintenance of the system from 2027 onwards.

The Ministry of Construction said it will invest in, upgrade or hire infrastructure and technology services to connect with units and localities. This agency is also responsible for developing plans and managing allocated capital for investigation and database development. The Ministry of Agriculture and Environment will coordinate to connect and share from the national database on land.

The People's Committees of provinces and cities are assigned to develop and promulgate regulations on coordination in sharing and providing housing information and data in the area. Organizations and individuals are responsible for providing complete information on housing and the real estate market on time. When the shared software system is completed, people will provide information online.

Providing real estate ownership information from 2026

The Ministry of Construction proposed that from 2026, Vietnamese and foreign organizations and individuals will have to provide data fields including identification information (full name, identification number, legal documents); type of house ownership, address, area, quantity; duration and form of ownership; legal status...

The draft decree also adds information on beneficiaries of housing policies and support, including identification information, beneficiary types (social housing, housing for meritorious people, housing for the poor, near-poor, etc.), quantity and duration of benefits. People in the group eligible to buy social housing need to provide personal identification information, registration form (purchase, rent, hire-purchase) and the project to be registered.

For public housing, organizations and individuals will provide the quantity of assets, area, purpose of use, management status and assigned management unit.

Previously, Decree 94 on housing and real estate market database did not have detailed regulations on home ownership information of organizations and individuals.

Explaining this proposal, the Ministry of Construction said the new regulation helps improve the quality of collected data, thereby making information transparent, regulating the market, and meeting the legitimate needs of society.

Previously, on July 24, 2024, the Government issued Decree No. 94/2024/ND-CP detailing a number of articles of the Law on Real Estate Business on the construction and management of information systems and databases on housing and the real estate market.

In recent times, the Ministry of Construction has deployed the construction of an information system on housing and real estate market; periodically collecting and synthesizing information on housing and real estate market from shared data and reports of ministries, branches and localities to serve reporting to the Government, Prime Minister (quarterly) and direction and administration.

However, in the process of implementing the Decree, there are also some shortcomings and inadequacies that need to be reviewed and adjusted related to regulations on reporting frequency; content of collected information; methods of sharing and connecting data between related specialized databases... which do not ensure meeting the new requirements of promoting digital transformation, performing administrative procedures in the electronic environment, especially the requirements for "correct, sufficient, clean, and live" information and data according to the direction of the Politburo in Resolution No. 57-NQ/TU dated December 22, 2024. Therefore, the study to amend and replace Decree No. 94/2024/ND-CP dated July 24, 2024 of the Government is appropriate and necessary.

Previously, the Department of Land Management (Ministry of Agriculture and Environment) had instructed localities to adjust the land database according to the two-level government after the merger and attach land plot identification codes in the area with cadastral data.

The process of building an ID code for a land plot has 4 steps, including determining the characteristic points of the land plot; converting the location from the Vietnamese coordinate system to the international one; encoding the location of the characteristic points and updating the land plot spatial data table.

The current Land Law and its guiding documents do not specifically regulate information on housing ownership or real estate identification codes. However, many breakthrough regulations on land data and information management are stated in the law, implementing digitalization and national data interconnection.
