The Ministry of Planning and Investment is seeking comments on the draft Circular amending and supplementing a number of articles of Circular No. 06/2022/TT-BKHĐT guiding a number of articles of Decree No. 80/2021/ND-CP detailing and guiding the implementation of a number of articles of the Law on Support for Small and Medium Enterprises (SMEs).
The Ministry of Planning and Investment said that the actual implementation of Circular No. 06/2022/TT-BKHĐT over the past 2 years has revealed some problematic contents such as: some contents are not consistent with Circular No. 52/2023/TT-BTC of the Ministry of Finance on management activities to support small and medium-sized enterprises (SMEs); regulations on funding for activities to recognize consultants or remove them from the consultant network are not suitable; the content of some support contents is not clear (consulting on digital transformation solutions; renting, buying digital transformation solutions; participating in exhibitions, etc.); the application method is not consistent with the process of supporting SMEs and the process of planning, approving estimates, selecting service providers, etc.
Implementing the direction of the Government's leaders, the development of a draft Circular amending and supplementing a number of articles of Circular No. 06/2022/TT-BKHĐT is necessary to remove difficulties and obstacles, strengthen decentralization and delegation of authority, and promote the implementation of activities to support SMEs from the central to local levels.
Improve the effectiveness of SME support activities
The Ministry of Planning and Investment said that, regarding the guidance on supporting SMEs (Article 3), the requirement of agencies and organizations supporting SMEs to request SMEs to submit and store documents and records related to information and data of SMEs is unnecessary and causes compliance burden for both SMEs and work pressure for SME support staff. Therefore, the draft Circular has amended and supplemented the provisions in Clause 3, Article 3 in the direction that the two parties (agencies and organizations supporting SMEs and SMEs) jointly make a record of comparing documents and information related to determining the scale of SMEs, SMEs owned by women, SMEs employing many female workers according to the declaration of SMEs and SMEs are responsible for the declared information.
At the same time, Clause 4, Article 3 of Circular 06/2022/TT-BKHĐT is also amended and supplemented to clarify the cases of support for headquarters, branches, and representative offices of SMEs in different localities, providing a basis for agencies and organizations supporting SMEs to have grounds to support these cases.
In addition, in order to be consistent with the norms only stipulated in Circular No. 52/2023/TT-BTC dated August 8, 2023 of the Ministry of Finance, Clause 1, Article 6 of Circular 06/2022/TT/BKHĐT is amended and supplemented in the direction of eliminating regulations related to the rate of expenditure for management activities (1%) for the Ministry of Planning and Investment and the focal agencies of the Ministry, ministerial-level agencies and local Departments of Planning and Investment (2%). At the same time, Clause 2, Article 9 is also amended in the direction of not regulating the operating costs for implementing consultant accreditation.
Based on the practical needs of SMEs in the process of implementing Circular 06/2022/TT-BKHĐT over the past 2 years, the draft Circular has added Clause 4, Article 15 and Article 18 to provide specific guidance on activities to support SMEs in participating in trade fairs and exhibitions, and trade promotion as prescribed in Articles 22 and 25 of Decree 80/2021/ND-CP. Accordingly, the draft Circular stipulates that activities to participate in trade fairs and exhibitions include: participating in fairs, or participating in exhibitions, or organizing trade promotion delegations, or combined activities. The addition of these provisions aims to clarify the content of support activities, thereby, agencies and organizations supporting SMEs will facilitate the settlement of support activities from the state budget.
