Proposal to separate compensation and resettlement content of Ninh Thuan Nuclear Power Project into a separate project

It is necessary to separate into a separate project.

Implementing the conclusion of the Deputy Prime Minister on the implementation of the project of resettlement and site clearance for the Ninh Thuan nuclear power plants, the Ministry of Finance was assigned to preside over and coordinate with the Ministry of Justice, the People's Committee of Khanh Hoa province and relevant agencies to draft a Resolution of the Government on separating the content of compensation, support and resettlement into an independent project.

This draft Resolution is built on the basis of specific legal grounds: Resolution No. 41/2009/QH12 dated November 25, 2009 of the National Assembly on investment policy of Ninh Thuan Nuclear Power Project; Law on Public Investment and Land Law; direction of the Deputy Prime Minister in Notice 395/TB-VPCP.

Accordingly, the Ministry of Finance agrees with the proposal of the People's Committee of Khanh Hoa province that the Government allow the separation of compensation, support and resettlement contents of the Ninh Thuan Nuclear Power Project into an independent project called "Compensation, support and resettlement project to implement the Ninh Thuan Nuclear Power Project".

Previously, in Resolution No. 41/2009/QH12, the National Assembly did not decide to separate the compensation, support and resettlement contents into an independent project, but assigned the Government to organize the implementation simultaneously during the investment process. However, based on the provisions at Point b, Clause 2, Article 6 of the Law on Public Investment and Article 93 of the Land Law, the separation of this content is completely legal, ensuring feasibility and conformity with the implementation practice in the locality.

The Ministry of Finance said that the draft Resolution consists of 5 articles, specifically regulating the scope of regulation, presiding agency, capital source, enforcement effect and implementation mechanism.

The draft also determines the effective date of the Resolution as February 28, 2027, creating conditions for local agencies and units to have enough time to deploy and complete compensation and resettlement work.

Total investment 12,392 billion VND

One of the notable contents of the draft is the proposal to assign the People's Committee of Khanh Hoa province as the project's governing body, and at the same time allow the province to decide on project investment when the competent authority has not yet adjusted the investment policy and re-approved the Ninh Thuan nuclear power project.

According to the provisions of Clause 11, Article 4 of the Law on Public Investment, the governing body can be a ministry, a central agency or a locality. Previously, the Ninh Thuan Nuclear Power Project was proposed and implemented by the Ministry of Industry and Trade. However, if the Government allows the separation of compensation, support and resettlement into an independent project, assigning the People's Committee of Khanh Hoa province as the governing body is in accordance with current regulations, ensuring proactiveness and closeness to local realities.

Regarding scale and area, according to Decision No. 794/QD-TTg dated June 8, 2015 of the Prime Minister, the total land area recovered for the project is 1,279.52 hectares of 1,288 households, with 4,911 people. Of which, the area for the two factories is 998.01 hectares (Factory 1 is 544.1 hectares; Factory 2 is 453.91 hectares); the area of the two resettlement areas is 85.65 hectares, the residential area is 13.4 hectares; the cemetery area is 22.27 hectares; the pumping station area is 0.59 hectares and the resettlement area is 159.6 hectares.

In Report No. 70/BC-UBND dated September 5, 2025, Khanh Hoa Provincial People's Committee updated the total expected land recovery area to be 1,130.14 hectares, related to 1,153 households, with 5,229 people. Of which, the area for the two factories is 815.03 hectares (Factory 1 is 409.53 hectares; Factory 2 is 405.5 hectares); the area of the two resettlement areas is 119.25 hectares; and the auxiliary items remain the same as the previous decision.

Regarding capital, according to Decision 794/QD-TTg, the total investment of the first phase of the project is 3,235.516 billion VND, the capital is provided by Vietnam Electricity Group (EVN) according to the plan after agreeing with the People's Committee of Ninh Thuan province. Up to now, the disbursed capital has reached 96.64 billion VND, approved by the People's Committee of Ninh Thuan province in Decision No. 130/QD-UBND dated April 23, 2018.

Based on updated data, Khanh Hoa Provincial People's Committee reported a preliminary total new investment of the Compensation, Support and Resettlement Project of 12,392 billion VND - a significant increase compared to the old level due to the adjustment of the recovered area and actual land prices. The inventory work is currently being implemented, but there are still procedural problems due to waiting for the adjustment of the overall investment policy of the Ninh Thuan Nuclear Power Project.

According to local reports, early implementation of site clearance in 2025 is necessary to avoid additional costs and ensure the progress of site handover for other technical items. Allowing the Khanh Hoa Provincial People's Committee to decide on investment in the Project while the competent authority has not yet adjusted the investment policy is in accordance with the special mechanism stipulated in Clause 6, Article 19 of the Law on Public Investment and Clause 2, Article 4 of Resolution 206/2025/QH15 on handling legal problems for special public investment projects.

The Ministry of Finance believes that issuing a Resolution to separate compensation, support, and resettlement into independent projects will help speed up progress, avoid wasting resources, and at the same time ensure stable lives for people in the project area.

After the Resolution is approved by the Government, the Ministry of Finance will continue to closely coordinate with the Ministry of Justice and the People's Committee of Khanh Hoa province in guiding, supervising the implementation and reporting the implementation results according to regulations.
