ByteDance may have to choose to sell TikTok in the US to keep the app running

TikTok's future now depends on the decision of the US Supreme Court, which will consider whether the TikTok ban is unconstitutional, according to Axios . However, Axios believes that the court's chances of upholding the law are very high.

In oral arguments on January 10, 2025, the justices indicated that the ban may not violate the US Constitution. The reason for this stems from the fact that "TikTok could continue to operate if it used a different algorithm than ByteDance," while "ByteDance is a Chinese company and therefore not protected by the First Amendment of the US Constitution."

If the ban is enforced on time and ByteDance does not sell TikTok, users in the US will not be able to download new apps or receive updates from the app store, resulting in TikTok becoming unusable.

Of course, the app won’t disappear from users’ phones immediately if they’ve already downloaded it. But if TikTok’s video library operator Oracle decides to stop hosting it, the app could be shut down more quickly, though that could hurt Oracle’s stock price.

There is another way users can access TikTok via browser using a VPN, but if their app store account is in the US, they won't be able to download updates.

Many people choose TikTok alternative apps

The report also found that some TikTok users have started to move to other social media apps. However, an app that TikTok introduced as an alternative called Lemon8 could also be similarly banned due to its ownership by ByteDance.

The emerging short-video app RedNote is gaining traction and is leading the social media category in the US App Store. Other services like YouTube Shorts and Instagram Reels are also attracting TikTok users as more TikTok content creators have started to come to these platforms.

TikTok currently has about 170 million users in the US, but only 32% of Americans support banning the app, according to a Pew Research Center survey. The US government 's decision to ban TikTok is largely based on national security concerns related to Chinese companies, including the spread of disinformation and espionage. TikTok has responded by arguing that the ban is unconstitutional and violates First Amendment freedom of speech.

If the US Supreme Court decides to uphold the ban, TikTok may have to turn to Donald Trump, who will be inaugurated as US president on January 20. Mr. Trump banned TikTok during his first term but has expressed his intention to keep TikTok alive if re-elected.
