Draft of the 2025 revised Law on Education: Many new regulations, attracting public attention

The 2019 Education Law is being revised and supplemented with the aim of further concretizing the Party and State's policies and guidelines on breakthroughs and modernization of education and training. At the same time, it opens up opportunities for lifelong learning, improving qualifications, skills and maximizing individual potential.

The Draft Law amending and supplementing a number of articles of the 2019 Law on Education (abbreviated as the Draft Law on Education amended in 2025) has many very new provisions that have attracted public attention.

Many new points on delegation of authority

The Education Law No. 43/2019/QH14 was passed by the 14th National Assembly on June 14, 2019, and officially took effect on July 1, 2020. After 5 years of implementation, the law has revealed a number of shortcomings and limitations. The draft revised Education Law 2025 removes the regulation on junior high school graduation certificates, assigning authority to junior high school principals and heads of educational institutions implementing junior high school education programs to confirm completion of junior high school programs. The draft stipulates assigning authority to high school principals and heads of educational institutions implementing senior high school education programs to issue senior high school graduation certificates.

Retired teacher Nguyen Van Tuan (Dong Xoai ward, Dong Nai province) said: The draft revised Law on Education 2025 has been amended in the direction of defining local educational materials as not textbooks; amending regulations on the authority to compile and appraise local educational materials in the direction of assigning specialized agencies under the Provincial People's Committee to organize compilation, the provincial appraisal council to appraise and the provincial People's Committee to approve.

Clause 16, Article 1 of the Draft Law on Education 2025 amended and supplemented Article 55 of the Law on Education 2019 as follows: The school council of a public university and vocational training institution is a school governance organization, representing interested parties. The school council of a private nursery, kindergarten, or preschool is a school governance organization, nominated by the community that established the school. The school council of a private nursery, kindergarten, preschool, or private general education institution is a school governance organization, exercising the right to represent investors and interested parties, and is responsible for organizing the implementation of investors' decisions...

The draft revised Law on Education 2025 stipulates: Local educational materials are compiled by the Department of Education and Training to meet the needs and suit the characteristics of the locality, are appraised by the provincial appraisal council and approved by the Chairman of the Provincial People's Committee... The draft does not mention the knowledge capacity of local educational materials, leading to the situation where localities may include too much content, exceeding the absorption capacity of students. Therefore, it is necessary to supplement the regulation assigning the Ministry of Education and Training to specify the capacity framework, ensuring consistency and conformity with the general education program.

Teacher Pham Thi Dung, Truong Son Secondary School (Phu Lam Commune, Dong Nai Province) said: The school council is a governing body, representing the collective in deciding important issues of the school. This is also an organization that demonstrates democracy, transparency and promotes the autonomy of schools. In order not to be a formality, the school council must promote its proper role, school leaders need to strengthen the real power of the school council and members of the school council need to promote their roles and responsibilities.

High consensus

Clause 7, Article 1 of the Draft Law on Education 2025 amended and supplemented Article 32 of the Law on Education 2019 as follows: Each subject has one or several textbooks, the compilation of textbooks is socialized, and the publication of textbooks is carried out in accordance with the provisions of law. The Director of the Department of Education and Training decides on the selection of textbooks for stable use in general education institutions in the area according to the provisions of the Minister of Education and Training.

Ms. Le Ngoc Nu (Long Khanh ward, Dong Nai province) expressed: "I support the policy of using a unified set of textbooks to avoid waste. I hope the Government will regulate free textbooks for students, implement appropriate socialized solutions for textbooks, while ensuring sustainability and meeting the requirements of improving the quality of education."

The amendment and supplementation of a number of articles of the 2019 Law on Education will meet the requirements of international integration and digital transformation, while ensuring consistency with new legal regulations and policies on reorganizing the apparatus, administrative units at all levels and decentralization and delegation of power.

Lawyer Chu Van Hien, Deputy Head of the Propaganda, Dissemination and Law Development Department, Dong Nai Province Lawyers Association, shared: It is necessary to ensure consistency in compiling, appraising, printing and using textbooks. Thereby, contributing to maintaining common standards of education quality, creating fairness in access to knowledge between regions, especially remote areas, ethnic minority areas. Unifying a set of textbooks compiled, provided and controlled by the State will help prevent the risk of forming group interests, prevent negativity, and at the same time save social costs.

Given the shortcomings of the 2019 Education Law, it is necessary to amend and supplement a number of articles. This is the wish not only of the education sector, those working in the education sector, but also of many parents across the country.
