The Ministry of Finance has just sent a document to the Ministry of Transport regarding the investment plan for the Hoa Binh - Moc Chau expressway section (section Km0 - Km19).

Regarding the separation of the expressway section Km0 - Km19 of the Hoa Binh - Hanoi regional linking road project and the Son La expressway (Hoa Binh - Moc Chau), assigning the People's Committee of Hoa Binh province as the managing agency of this section, according to the Ministry of Finance, the Ministry of Transport is the agency performing the state management function of road transport nationwide.

According to the draft dispatch of the Ministry of Transport reporting to the Deputy Prime Minister, assigning the People's Committee of Hoa Binh province as the competent authority to invest in the Hoa Binh - Moc Chau expressway (section Km0-Km19) at this time is not in accordance with the 2008 Road Traffic Law currently in effect.

However, according to the 2024 Road Law (effective from January 1, 2025), national highways and expressways can be invested by localities when decentralized or approved by the Prime Minister for management.

"In case the Prime Minister assigns management of the Km0-Km19 expressway section, the People's Committee of Hoa Binh province will be the competent authority to implement the project and arrange local resources for implementation.

Based on the above situation, the Ministry of Transport coordinates with the People's Committee of Hoa Binh province to determine investment authority, investment capital sources, carry out investment preparation procedures... in accordance with the provisions of the law on road traffic, state budget, public investment, construction and other relevant laws.

The separation of the expressway section Km0-Km19 must comply with the provisions of the Law on Public Investment and be reported to competent authorities for consideration and decision," the document stated.

According to the Ministry of Finance, the agencies have not yet determined the specific investment time, capital sources, and structure of investment capital sources.

After identifying the competent authority to invest in the Hoa Binh - Moc Chau expressway, section Km0-Km19, the Ministry of Finance proposed that for the contents to be implemented in the medium term period of 2021-2025, relevant agencies shall comply with the provisions of the 2019 Law on Public Investment and the provisions of the amended Law on Public Investment (after promulgation).

"For the medium-term period of 2026-2030, the Prime Minister issued Directive No. 25 dated August 8, 2024 on planning medium-term public investment for the period of 2026-2030. The Ministry of Planning and Investment is submitting to competent authorities for consideration and decision: Law amending and supplementing the Law on Public Investment in 2019; Developing principles, criteria and norms for allocating development investment capital from the state budget for the period of 2026-2030.

The Ministry of Transport and the Provincial People's Committee shall implement based on current legal regulations and the above regulations (after being issued by competent authorities), the Ministry of Finance proposed.
